That [he proposed use is properly one for which a conditional use permit fs authorized by Anaheim Municipal Code Section 18.03•~30.010 to Hit: to permit private tennis lessons tn an existing apartment canplex. 2, That ehe proposed use is hereby granted for a two-year perlod of time~ subJect to consideration and review by the Planning C~xm~ission for possible extensions of time upon wrltten request by the petttion to deCermine wheth~r the use has had an adverse impact on tha apartment complex in terms of traffic, parking and regular tenant use of the tennis courts. 3, That the proposed use is hereby granted subject to the petitloner's sttpulacion to use only one tennis court for private tennis lessons and to 1tmI[ the hours for instruction to the following: Mondays and Tuesdays Wednesdays and Thursdays Saturday 9:00 a.m. to 9:00 p.m. 9:00 a.m, to 6:00 p.m, 8:00 a.m. to 12:00 noon PC78-t3o 4. That the proposed usc wtll not adverscly affect the adJolntng land uses and the growth and development oF the area in whlch it is proposed to be located, 5. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrfinental to the particular area nor to the peace, health, safety, a~d general welfare of the CiLlz~ns of the City of Anaheim. 6, That the grantfng of the Conditlonal Use Permtt under the condiitons imposed, if any, will not be detrimental to the peace, health, safety and general welfare of [he Citizens of the City of Anahelm. 7. That no one indicated iheir presence at said public hearing tn opposition; and that no correspondence was received in opposition to the subJect petitlon. ENVIRONMENTAL IMPACT FIP7DING: The Plan~ing Director or his authortzed representat ve has determ ned that the proposed pro,ject falls within the definition of Categor(cai Exemptions, Class t, as defined tn Paragraph 2 of [he City of Anaheim Environmental Impac[ Report Guldeltnes and is, therefore, categorically exempt from the requtrement to prcpare an EIR. NOW~ THEREFORE~ BE IT RESOLVED tha[ the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permlt, upon the following conditions which are hereby found to be a necessary p~erequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That subject propercy shall be developed substantial7y in accordance with plans and specifications on ffle with the City o` Anah~im marked Exhibit No. 1. 2. That the use is hereby granted for a twe-year period of time subject to consfderation and review by che Planning Commission for possible extenslons of time upon written request by the petitioner if it is determined that the use has not had an adverse impac[ on the apartment project in terms of traffic, parking, and regular tenant use of the tennis courts, 3.
