A RESOLUTION OF THE ANAHEIM CITY PLANNINr, COMMISSION
THAT PETITION FOR CON~ITIONAL USE PERMIT N0. 1844 BE GRAI~TED
WHEREAS~ the Anaheim City Planning Canmtssion did recetve a verified
Petitlon for Co~ditional Use Permit fran LEWIS R. AND JUDITH E. SCHMID, 168i Langley
Avenue~ Irvine, California, 92714, owners, and ANDREW KALANZ~ 2560 East fatella
Avenue. Rnaheim, Callfornia 92805. agent, of certain reat property situated in the
Ctty of Anaheim, County of Orange~ State of California, descrlbed as:
Parcel 1~ as shown on a map filed in book 106, page 12 of Parcel
Maps, in Lhe Office of the County Recorder of said Orange Lounty.
WHEREAS~ the City Planntng Commtssion did hold a publTc hearing at the City
Nall Jn the City of Anahe(m on Ju~e 19, 1978~ at 1:30 p.m.~ notlce of said public
hearing having been duly given as required by laa and in accordance with the
provisions of tl~e Anaheim Municipa) Code, Chapter 18.03, to hear and consTder
evidence for and against said proposed conditional use and to investigate and make
findTngs and recommendations in connection therewTth; artd
WHEREAS, said Crnr+isston, after due tnspection. investTgatTort and study made
by Ttself and tn its behalf, and after due consideration of all evTJence and reports
offered at said hearirtg~ does find and determine thc foila+ing facts:
1. That the proposed use is properly one for Wfiich a condicinal use permTt
is authorized by Anaheim Municipal Code Section 1$.03.030.Q10 to wiC: to permit on-
sale beer and wine in a recreational facillty.
2. That [he proposed use is hereby granted subject to the petitioner's
stipulatton thai the hours af beer and wine servlce atil be cotermtnous with tht
~ours of operation of the recreationai faciilty approved in connectlon with
Condicional Use Permit No. 1707.
3. That the hours of operation will typically be:
Monday - FrTday 6:30 a.m, to 10:30 p.m.
Saturday 5:00 a.m, to 6:00 p.m.
Sunday 9:00 a.m. to 5:00 p.m.
4. 7hat the proposed use will not adversely affect Che ad)otning land uses
and the growth and developmen[ of the area tn r+hich tt is proposed Co be located.
5. That the size and shape of the siLe p~oposed for the use Is adequate to
allo++ the ful) development of the proposed use in a rn~nner not detrimental to the
particular area nor to the peace. health. safety~ and general welfare of the CitTzens
of the City of Anaheim.
6. That the granting of the Conditional Use Permit under the conditTons

opposition; and that no correspondence was recelved in oppositlon 2o the subJect
petition.
ENVIRONMENTAL IMPACT FIFIDING: The Planning Director or hts authorized
representative has determined that the proposed proJect falls within the definition
of Categorical Exemptlons, Class 1. as defined in Paragraph 2 ~f the Ctty of Anaheim
Environmental Impact Report Guidclines and is, therefore, categoricaily exempt from
the requirement to prepare an EIR.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Camnission
does hereby grant subJect Petition for Con~itional Use Permit, upon the following
condi2tons which are hereby found to bP a necessary prerequisite to the proposed use
of the subject properiy in order to preserve the safety and general welfare of the
Citizens of the City of Anaheim:
1, That subJect property shaii be developed substantially in accordance
with plans~ and specif(cations on file ~ith the City of Anaheim marked Exhibit Nos. 1
through 4.
BE IT FURTHER RESOLVED tha[ the Anaheim City Planning Commission does hereby
find and determine that adoption of this Resolution is expressly predtcatad upon
applicant`s compitance with each and all of the conditions hereinabove set forth.
Should any such condition, or any part thereof, be declared invalid or unenforceable
by the final Judgment of any court of competent JurlsdicYlon, tf~en this Resolution,
and any approvals hereln contained, shall be cleemed null and vold.
