PC78-135 A RESOLUTION OF THE ANAHEIM C1TY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1845 BE GRANTED WHEREAS, the Anaheim City PlannTng Commission dtd receive a verified Petition for Condltional Use Permit fra-n BANK Of AMERICA NATiONAL TRUST AND SAVINGS ASSOCIATION~ 801 North Main Street, Santa Ana, California 92701, owner of certain real property situated in the City of Anahetm, County of Orange, Scate of California, described as: Lots 1, 2 in Dlock "H" of the Center TracC. recorded tn Book 14, and 13 of Miscellaneous Maps, records of Los A~9eles County, California. 4fNEREAS, the City Planning Commission did hold a publtc hearing at the Clty HaII in the City of Anaheim on June 19, 1978, at 1:30 p.m., notice of safd public hearing having been duty given as required by iaw and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendattons ir connection therewith; and WHEP,EAS, sald Commtssion, after due inspectlon, investi9ation a~d study made by itself and in lts behalf, a~d after due consideration of all evidence and reports offered at said hearing, does ftnd and determine Lh~ following facts: 1. Tha[ the proposed use is properly one for which a condttional use permlt is authorized by Anaheim Municipal Code Section 18.45,050.060 to wi[: Eo expand an automobile sales agency. 2. That the proposed use is hereby granted subJect to the petitioner's stipulation [hat the maximum width of the proposed driveway on Anaheim Boulevard shall be 30 feet. 3, That the proposed use will noC adversely affect the adJofning land uses and the growth and development of the area in which it is proposed to be located. 4. That the size and shape of the sice proposed for the use is adequate to allow the fult development of the proposed use in a ma~ner not detrimentat to the particular area nor to *_he peace, health, safety, and general welfare of the Cittzens af the City of Anaheim. 5. That [he granting of the Conditionat Use Permtt u~der Lhe c4nditions imposed, !f any, will not be detrimentai to the peace, health, safety and general r~elfare of the Citizens of the City oF Anaheim. 6. That no one lndicated their presence at sald public hearing in opposition; and that no correspondence was received in opposition to the subJect petition. ENVIRONMENTAL IMPACT FIt~DING: That the Anahelm City Planning Commissfon has review~d L e su ject proJect to expand an auiomobile sales agency on a rectangularly- shaped parcel of land consistfng of approximately 0.3 acres locat~d at the southeast PC78-135 i J corner of Broadway and Anaheim 8oulevard having approximate frontages of 90 feet on the south side of Broadway and 135 fcet on the east side of Anahetm Boulevard; and does hereby approve the Negative Declaraiton from the requlrement to prepare an environmental impact report on tfie basis that there would be no significant individual or cumulative adverse environmental impact due to the approval pf this Negative Declaration since the Anaheim Generai Plan designates the sub)ect property for general cortmercial land uses commensura[e wfth the proposat; that no sensitive environmental impacts are involved in the proposal; thaL the lnitlai Study subm(tted by the petitioner (ndicates no sig~ificant indivldual or cumulative adverse environmental impacts; and [hat the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning ~epartment. NON~ THEREFORE, BE IT RESOLVEO [hat the Anahel~ City Plannin9 Commtsslon does hereby grant subJect Petltlon for Condltional Use Permi[, upon Yhe following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safe[y and general welfare of the Citizens of the City of Anaheim: 1. That the owner(s) of subJect p~operty shall submit a letter requesttng the termination of Condttional Use Permit No. 486. 2. That subJect property shall be developed substantialiy in accordance with plans and specificatlons on file with [he City of Anaheim marked Exhibit No. t; provided, however, that the existing driveway on Broadway and the existing most nortlierly driveway o~ Anaheim fioulevard shall bc removed and replaced with standard curb, gutter and sidPwaik; and [hat the remaining driveway on Anaheim Boulevard shall have a maximum width of thirty (30) feet. 3. That Condition No. 1, above mentioned, shall be compiled with prior [o the cortmencement of the activtty authorized under thls resolutlon, or prlor to the time that the building permit ts issued, or within a perlod of one year fran date hereof~ whichever occurs first, or such further time as the Planning Commisston may grant. 6. That Condition No. 2, above mentioned, shall be ~omplied with prior to final butiding and zontng inspectlons. BE IT FURTHER RESOLVED that the Anah~im City Planning Commission does hereby find and determine Chat adopilon of this Resolution is expressly predicated upon applicant's compl3ance :•~ith each and ali of the conditlons hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the finai judgment cf any court of competen[ Jurisdiction, then this Resolution~ and any approvals herein contatned, shall be deemed null and void.
