WHEREAS, the City Planning Cort+mission did schedule a pubtic hearing a*_ the
City Hall in the Cicy of Anaheim on June 19, 1978, a[ 1:30 p.m., notice of said
public hearing having been duly given as requlred by law and in accorda~ce with the
provisions of the Anaheim Municipal Lode, Chapter 18.03, to hear and consider
evldence for and against said proposed co~ditional use and to investigate and make
findings and recommendations in connection [herewith; said oublic hearing having been
continued to the Planning Commissior. meeting of July 3, t978; and
NHEREAS~ said Casimission, after due tnspection, tnvestigation and study made
by itself and in its behalf, and after due consideration of all evTdence and reports
offered at said hearing, does find and determine the foilowing facts:
t. That the petitioner proposes a waiver of the following to construct
seven (7) freestanding sTgns at a proposed service staiton:

2, That the petitioner presented revtsed plans (labeled RevisTon No. 1 of
Exhibit Nos. 1~ 2 and 3) at the public hearing eliminating three of the requested
signs (one each on McKinnon Drtve. Lakevtew Avenue~ and at the corner of McKinnon
Orlve and Lakevlew Avenue); and requesting approval of two wall-mounted sTgns on the
structure {company identificatlon and prTce signing) sald wall stgns no[ to exceed in
area 10$ of the area of the face of the building and two service identifTcation sTgns
on the pump Islands ~one "self-servlce" and one "full-service").
3, That the requested waive~ is hereby granted for the signs shown on the
revlsed plans on the basis that this is a"reversed" servfce statlon site and the
pump islands are not located adJacene to the adJoinirsg streets and are not fully
vlslble from the intersectTon, and that the service tdentification signs located on

the pump islands are necessary to eilminate confusion for the customers and unsafe
on-site traffic conditlons.
3. That the proposed use. as granted, will not adversely affect the
adJolnTng land uses and the growth and development of the area in which tt is
proposed to be located.
4, That the size and shape of the site proposed for the use~ as granted,
is adequate to allow the full development of the proposed use in a manner not
detrimental to the particular area nor to the peace. health, safety, and general
welfare of the CTtizens of the City af Anaheim.
5, That the Cond;tlonat Use Permit, as granted, and under the conditions
imposed, will not be detrimental to the peace~ health, safety and general welfare of
the Citizens oF the City of Anaheim.
6. That one person indicated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to the subject
petttTon.
ENVIRONMENTAL lMPACT FINDItIG: The Planning Director or his authorized
representative has determined that the proposed project falls within the dcfinition
of Categorical Exemptions~ Class 11, as deftned ln Paragraph 2 of the City of Anaheim
Environmentai Impact Report Guidelines and is, therefore, categorlcally exempt from
the requlrement to prepare an EIR.
NOW. THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant. in part, subJect Petitlon for Variance, upon the following
conditions whlch are hereby found to be a necessary prerequisite to the proposed use
of the subJect property in o~der 2o preserve the safety and general welfare of the
Citizens of thc City of Anaheim:
1. That subject property shall be developed substantially in accordance
with plans a~d speciflcations on fTle wtth the Cfty of AnaheTm marked Revision No. 1
of Exhibit Nos. 1. 2 and 3.
BE IT FURTHER RESOLVED that the Anaheim City Plannin9 CommissTon dces her~by
find and determine that adoption of this ttesolutlon is expressly predicated upon
applicant's compliance wiCh each and all of Lhe conditlon. hereinabove set forth.
Should any such condition, or any part thereof, be declared invaltd or unenforceable
by the final judgment of any court af compete.nt Jurisdiction, ther this Resolutton,
and any approvals herein contalned~ shall be deemed null and void.
