WHEREAS, the Anaheim City Planning Cmmission dld receive a verified
Petition for Conditiona) Use Permit fr~m LA PALMA PA.°.TNERS, 477~ Campus Orlve,
Newport Beach, California, 72G6C, owner, anJ DOi::.LU R. FOTEETE, 10172 Merrimac,
Huntington Beach, California 42648, agent, of cer[ain real property situated in the
City of Anaheim, County of Oran9e, State of California, described as:
Those portions of the West half of the North~~est quarter of
Section 4, Tormship ~~ South, Range p West, San Hernardino
Meridian, according to the Official Piat of said la~d filed tn [he
District Land Office, March 23, 12.75, descrihed as follows:
Parcel 4, as shown on a Map recorded in book 9~i, page 13, of
Parcel Maps in the office of the Coun[y Recorder of Oran9e Coun[y,
California.
WNEREAS, the City Pianning Corimfssion did hold a puhlic hraring at the Lity
Nall in the City of Anaheim on January 15, 1°7E, at 1:3^ p•m., netice of said publie
hearin~ havina been duly given as required by law and in accordance with the
provisions af the Anaheim Municipal Lode, Chapter 18.f13, to hear and consider
evidence for and aqainst said proposed conditiona) use anrl [o investigate and make
findings and recommendations in connection therewith; and
NHEREAS, said Comi^ission, after duc inspection, investin~tion and study made
by i[seif and in its 6ehalf, and after due consideration of all evidence and repor[s
of`ered a[ said hearing, does find and de[erminc the follorring facts:
i. That the proposed use is proaerly one for which a conditional use
permit is authorized by Anaheim Municipal Code Section 18.~~1.05~•~S~ to wit: to
permit an automobile sales and leasing facility with Naiver of:
SECTIO~! 18.06.060.022 - Mi~imum parkinq spaces.
53 spaces required;2 spaces
propnsed.
2. That the proposed use is hcreby denied on the basis that it is a
commercial use which would be an intrusion into the industrial zone, that it would
not primarily serve com~erce and industry, with only incidental service to the
general public, and that approval rrould set an undesirable precedent.
3. That the proposed use will adversely affect the adJoining land uses and
the growth and development of the area in which it is proposed to be located.
4. That [he size and shape of the site proposed for the use is not
adequate to allow the full develooment of the proposed use in a manner no[
detrimental to the partlcular area nor [o the peace~ health, safety, and general
welfare of tfie titizens of the Ctty of Anahcim,

5. That the granting of the Conditionai Use Permit under the conditions
imposed, if any, rrtll be de[rimental to the peace, health~ safety and general welfare
of [he Citizens of the City of Anaheim.
6. That no one indicated their presence at said public hearing in
opposition; and that no correspondence was recetved in opposition to the subject
peti[ton.
ENVIROt~MEtlTAL IMPACT FINDING: The Director of the Plannin~ Department has
determined that the proposed activfty falls ~~+ithin the definition of Section 3.01,
Classes 1 and 5, of the Ci;y oT Anaheim Guidelines to the Requirements for an
Environmental Impact Report and is, therefore, categorically exempt from the
requirement to file an EIR.
MOW~ TNEREFCP,E, BE IT RESOLVED that tfie Anahelm City Planning Commisslon
does hereby deny subject Petition for Londitional Use Permit on the basis of the
aforemen[ioned findin9s.
TI1E FOREGOING RESOLUTION is signed and approved by me this 16th day of
