PC 78-141R£50LUTION P10. PC78-141 A RESOLUTION OF THE ANAHEIM CITY PL~NNING COMMISSION THAT PETITION FOR RECLASSIFICATION N0. 78-79-1 BE GRANTED. WHEREAS~ the Anahelm City Planning Commission did receive a verTfied petttion for Feclasstftcation from JAI4E5 E, AND BERTIE L. HAZEIL, 620 South Harbor Boulevard, Anaheim, Ca~ifornla 92805, owners, of certai~ real property situated Tn the City of Anaheim, County of Orange, State of California, described as follows: Lot 9 in Block D of Tract 406~ as per map recorded in Book 16 page 7 of Miscellaneous Maps, in [he office of the County Recorder of sald County. WNEREAS, the City Planning Commission did hold a public hearing at Lhe City Hall in thP City of Anahetm on July 3, 1?78, at 1:30 p.m., notice of said public hearing having been duly giver, as required by law and in accordance with the provisions of the Anaheim Nunictpal Code, Lhapter 18.03, to hear and consider evidence for and against sald proposed reclassificatlon and to investlgate and make findings and recommendations fn connection therewith; a~d NHEREAS, said Commissfon, after due lnspection, investlgation and study made by ttself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1, That the petitioner proposes reclassification of subJect property from the RS-7200 (Resldential, Single-Family) to the CL (Commercial, Ltmited) Zone. 2. Tha[ although the Anahetm Generai Plan designates subjecc property for commercial professlonal land use, nearby propertles have been zo~ed for general canmercial tand uses. 3. That the proposed reclassificatlon of subJect property Ts necessary and/or desirable for the orderly and proper development of the cortmunity. 4, That the proposed reclassification of subJeci property does properly relate to the zones and cheir permi[ted uses iocally established in close prox}mity to subject property and to the zones and their permitted uses generally establlshed throughaut the comnunity. 5. That no one indica[ed thetr presence at said public hearing in opposition; and that no correspondence was received in opposition to the subJect pet i t tor.. ENVIRONMENTAL IMPACT FINDING: That the Anaheim Clty Ptanning Cortmission has reviewed the subJect proposa to rec assify the zoning from RS-7200 (RESIDENTIAL, SINGLE-FA111LY) to the CR (COMMERCIAL, LIMITED) on a rectangularly-shaped parcei of land consisting of approximately 4803 square feet, having a frontage of approxlmately 4) feet on the east side of Harbor Boulevard, having a maximum depth of appraximately 102 feet, being located approximately 253 feet south of the cente~ltne of Water Street; and does hereby approve the Negative Declaratton fran the requirement to prepare an environmental impact report on the basis that there would be no signtficant lndividual or cumulattve adverse environmental impact due to the approval of this Negative Declaration stnce the Anaheim General Plan designates the subJect PC78-141 property for commercial professional land uses commensurate with the proposal; that no sensitive envlronmental impacts are involved in the proposal; that the InTtial Study submitted by the petitioner indicates no signiftcant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the City of Anaheim Planning Department. NOW~ THEREFORE, BE IT RESOLVED that the Anaheim City Plannin9 Cortmission does hereby grant subJect Petiti~n for Reclassification and, by so doing, that Title 18-Zoning of the Anahelm Municipal Code be amended to exclude the abov~-descrlbed property from tl~e RS-720Q (RESiDENTIAL, SINGLE-FAMILY) ZONE and to incorporate said described property into the CL (COMMERCIAL, LIMITED) ZONE upon the following condltions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the Lity of Anaheim: 1, That trash storage areas shail be provided in accordance with approved plans on ftle with the Office of the Director of Pubiic Works. 2. That [he vehicular access rights to Harbor Boulevard shall be dedicated to the Lity of Anaheim. 3, That the existing structure sfiail be brought up to the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Mechanical and Fire Codes as adopted by the City of Anaheim. 4, Prior to the introduction of an ordinance re~oning subJect property, Condi[ton No. 2, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the Planning Commission unless said conditions are complied with withi~ one year from the date hereof, or such further time as the Planning Commtssion may grant. 5. Thzt ~ondi[ion Nos. i and 3, above-mentioned, shall be complied with p~lor to final building and zoning inspections. BE IT FUR7HER RESOLUED that the Anaheim City Planning Commisslon does hereby find and determine that adoption of this Resolution ls expressly predicated upon appilcant's compliance with each and all of [he condit(ons herei~above set forth.
