4MEREAS, the City P(•nning Commission did hold a public hearing at the City
Halt in the City of Anaheim an July 3, 1973, at 1:30 p,m., notice of sald public
hearing having been duly given as requtred by laN and in accordance wTth the
provisions of the Anahe(m Municipal Code, CFw pter 18,03, to hear and consider
evidence for and agalnst said proposed conditional use and to investTgate and make
findings and recormendations in connection therewith; and
WHEREAS, said tommfssion, after due inspection, investige[ton and study made
by itseif and in lts behalf, and after due consideration of alt evidence and reports
offered at said hearTng, does find and determine the following facts:
1, That the proposed use is properly one for whlch a conditional use
permic is authorized by Anahelm Munfcipal Code Sec[lon 18.44.050,010 to wit: to
expand an existing cocktall lounge.
2, That the p~opose~ ::~~ wlil not adversely affect the adjoTnt~g land uses
and the growth and development of Che area in which it ts proposed to be located.
3, That ttie stze and shape of tht site proposed fior the use is adequate to
ailow the full development of the proposed use t~ a manner not detrTmental to the
part~cular area nor to the peace~ health, safet~. and general welfare of the Littzens
of the City of Anaheim.

4, That thc granting of the Conditlonal Use Permit under the condittons
Imposed~ if any. will not be detrimental to the peace~ health. safety and general
welfare of the Citizens of the Ctty of AnaheTm,
5. Thai no one Indicated their presence at said public hearing in
opAosition; and '_hat no carresponder~ce was received Tn opposition to the subject
petition.
ENVIRGt1MENTAL IMPACT FINDING: The Planning Director or his authorized
represeniatlve has determined that the proposed proJect falls within the definTtton
of Categorical E.cemptions~ Class 1. as defined tn Paragraph 2 of the City of Anaheim
Environmental Impact Rtport Guidelines and Ts, therefore, categorically exempt frun
the requlrement to prepare an EIR.
NOW~ TNEREFORE, BE fT RESOLVED that the Anaheim City Planning Commlssion
does hereby grant subJect Petition for Condttional Use Permlt. upon the following
conditlons which are hereby found to be a necessary prerequisite to the proposed use
of Lhe subject proper[y in order to preserve the safety and general r+elfare of the
Citizens of the City of Anaheim:
1, That the cxisting structure shall be brought up to the mtnTmum
standards of the City of Anaheim, including the Uniform 8uilding~ Plumbing,
~lectrical, Mechantcal and Flre Codes as adopted by che City of Anahcim.
2. Thst subJect property shall be developed substantiaTiy in accordance
with plans and specifications on file wi[h the City of Anahelm marked Exhibit ~tos. S
and 2.
3, That Condi[ton No. 2, above-mentioned, shall be complied with prlor to
final bullding and zoning inspectloi~s.
BE IT FURTHER RESOLVED that the Anahelm Ctty Planning Cartmission dces hereby
find and netermine [hat adoption of this Resolution ia expressly predicated upon
applicant's compliance with each and atl of the condittons hereinabove set forth.
Should any such cendttlon, or any part thereof, be decfared invaiid or unenTOrceabie
by the finat Judgment of any court of compe[ent )urisdiction, then this Resolution.
