NHEREAS, the City Planning Commission did hold a public hearing at the Lity Hall in the City of Anaheim on Decemher 5, 1977, at 1:30 P•m., notice of said pubiic hearing having been duly given as required by law and in accordance with the prr,visions of the Anaheim Municipal Code. Chapter 1~.03, to hear and consider evidence for and against said proposed reclassification and to tnvesti9ate and make findtngs and recommendations in connection therewith; said public hearing having been continued to the Planning Commission meeting of January 3~, i~lA; and WHEREAS, said Gommisslon, aftcr due {nspection, tnvesti9ation and s[udy made by itself and in its behalf~ and after due consideration of all evldence and reports offered at said heartng, does find and determinc the followinq facts: i. That the petitioner proposes reciassification of subJect property from the CL (Corm~erical, Limited) Zone to the R"t-12R0 (P.esidential, Multiple-Family) Zone. 2. That the Anaheim General Plan designates subJect property for general commercial uses and/or medium-density residenttal land uses. 3. That the proposed reclassificatfon is hereby granted on the basis that any modlfica[ions co the development plans as presented shall be reviewed and approved by thc Planning Canmtsslon prlor to the issuance of buTiding permits. 4. That the proposed reclassificatlon is hereby granced subJect to peti[Toner's sttpulatlon to provide adequate trash enclosures as approved by the Sanitatton Department. 5. That the proposed reclassification of subJect property is necessary and/or desirable for the orderly and proper dcvelopment of thr community. Pt7g-~5 6. That approximately tNenty (20) persons indlcated iheir presence at said public hearings in nppositton; and five (5) letters M~re received irt opposition; and two petitions, ane cor.taining approximately sixty-eight (~°) signatures, and the second containing seventy (70) signatures (forty (40) of which had signed the first peiition) were submitted in oppositton to zubject request. ENVIRONMFNTAL IMPAC7 FI1101NG: Tha[ [hc Anaheim City Planning Commission has reviewed the subject proposal to reclassify the zoning from CL (CQ"1'1ERCIAL~ L~MITED) to RM-1200 (RESIDEtITIAL, MULTIPLE-FA`11!Y) zoning on a rectangularly-shaped parcel of land consisting of approximately 2.~~ acras having a frontage of approximate'.y 412 feet on the east side of Beach Boulevard, having a maximum depth of approximately 279 feet, and being located approximntely 435 feet north of the centertine of eall Road; and does hcrehy approve the NegativA Declaration from the requirement to prepare an environmental impact report on the basis that [here would be no significant individual or cumulative adverse enviromental impact due to the approval of this Nega[ive Declara[ton since the Anahein General Pian designates the sub,ject property for 9eneral commercial and medium-density residential land uses carmensurate with the proposal; that no sensitive environmenial impacts are involved in the proposal; that the Initial St~idy suhmitted by the peeitioner incficates no signifi'cant individual or cumulative adverse environmental impacts; a~d that the Negative Declaration substantiating the foregoing findinas is an file in the Cfty oF Anaheim Planning Department. NOW, THEREFORE~ flE IT aE50LVED that the Anahetm Ctty Planning Commission does hereby grant subject Petition for Reclasstftcation and, by so doing, that Titie 18-Zoning of the Anaheim Municipal Code be amended to exclude the above-described property f:om the CL (LOMMERCIAL, LIhf17ED) 7_OI~E and to incorporate said described property (nto the RH-TZ4d (RESIuEtiT1AL. MULTtPLC-Fw";tlY) ZOPlE upan Lhe fallor~ing conditions o~hich are hereby found to be a necessary prerequisite to the proposed use of subJect property in order to preserve the safety and general welfare of the Littzens of the City of Anaheim: 1. Thc sidewalks shall be installed along Beach 8oulevard as required by City Eningeer and in accordance w(th standard plans and spectftcations on file in the offtce of the C(ty Engtneer. 2. That street lighttng facilities alona Beach Boulevard shall be ins[alled as requtred by the Dlrec[or of Public Utilities, and in accordance with standard plans and specificat(ons on file in the offlce of the Director of Public Utitities, and/or that a bond, certtficate of deposit, let[er of credit or cash, in an amount and form satisfactory to thc City of Anahe(m shal! be posted with the City to guarantee the installation of the above-mentloned requirements. 3, That the owner(s) of subJect property shall pay to the Ctty of Anaheim the sum of 60 cents per front foot along Beach Boulevard for tree planting purposes. 4. That trash siorage areas shall be provided in accordance with approved plans on file with tht office of the Director of Public Works. -2- PC78-15 ,; 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That subJect property shall be served by underground utilitles. 7, That drainage of subJect property shall be disposed of in a manner satisfactory to the City Engira~r. 8. That the owner(s) of subject property shall pay to thc City of Anaheim that appropriate park and recreatlon in-lleu fees as determined to be appropriate by the City Council, said fees to be paid at the tlRe the building permit is issued. 9. That appropriate o~ater assessment fees as det~rmined by the Director of Public Utilities shall 6e paid to the City of Anaheim prior to the issuance of a bullding permit. 10. Tha[ subject property shall be developed substantialiy in accordance with plans and specifications on file with the City of Anaheim marked Revision No. 2 of Exhibits 1-3, and that any modifications thereto shall be subnitLed to the Planning Commission for review and approval prior to ihe issuance of buiiding permits. il. The provisions or rights granted by this resolution shall became null and void by action of the Planning Commission unless said condtttons are complied with wiihin one year fran the date hereof, or such further time as the Planning Corrnnission may grant. 12. That Londition Nos. 1, 4, 6 and 7, above•mentioned, shall be complied with prior to final building and znning lnspecttons.
