A RESOLUTION OF THE ANAHEIM CITY PLANWING COHNISSIOPI
THAT PETITION FOR V/1RIANCE N0. 2985 BE GRANTED, IN PART
WHEREAS, the Anaheirn City Planning Commission did receive a verlfied
Petition for Variance from WRATHER IHNS, INC., 1855 South Harbor Boulevard, Anaheim,
California 92802 (owner) of certain real property situated in the City of Anaheim.
County of Orange, State of California described as follows:

WHEREAS, the City Planni~g Commission did schedule a public hearing at the
City Hall in the City of A~aheim on January 1F, 197~. a[ 1:30 p.m., notice of said
public hearing having been duly 91ven as requ(red by law and in accordance with the
provisions of the A~aheim Municipal Code, Chapter 18.03, to hear and consider
evidence for and against sald proposed variance and to investigate and make ftndtngs
and recommendations in connection therewith; said public hearing having been
continued to the Plannin~ Cormrission meeting of January 3~. 1°7~, and
WHEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf~ and after due consideration of al! evidence and reports
offered at said tiearing, does find and determine the following facts:
1, That the petittoner proposes a waiver of the following to construct two
free-standing signs and to retain a prohibited sign:
(a) SECTION 18.05•064 - Prohibited sian,

2, That the proposed waiver is hereby granted on the basis that a similar
waiver has been granted in the surrounding area for a sim(lar sign (a vehicle
utilized for advertising purposes) and denial rrould 6e denial of a privilege enJoyed
by other property oamers.

3. That the proposed waivers (b) and (c) are hereby denied on the basis
that the petitioner stipulated to providing dlrectional signing in accordance with
the Sign Ordinance and, therefore, the requested aiaivers are no longer necessary.
4, Tha[ the proposed waiver (d) is herehy granted in partto permit the
roof-mounted stage coach to be located eighty (n0) feet from the existing free-
standing sign, on the basis that a similar waiver has 6een granted in the surrounding
area for a similar vehicie utilized for advertising purposes and denial would be
denial of a privilege enjoyed by other property owners.
5. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved or to the intended use, as gran[ed~ of the
property that do not apply generally to the property or class of use in the same
vicinity and zone.
6. That the requested variance, as grantad, is necessary for the
preservation and enJoyment of a substantial prnperty right possessed by other
property in the same vicinity and zone, and denied to the property in question.
7, That the requested varfance, as granted, will not be materialty
detrlmenial to the public welfare or injurious to the property or improvements in
such vicinity and zone in rrhich the property is located.
8. That no one indicated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to the subject
petJtion.
ENVIROFIMENTAL IMPACT FINOING: 7he Dir'ector of the Planning Department has
determined that the proposed activity alls within the definition of Section 3.01,
Class 11, of the City of Anaheim Guidelines to the RAquirements `or an Environmental
Impact Report and is, therefore, categorically exempt from the requirement to file an
EIR.
NOW, THEREFORE, BE IT P.ESOLVED thaC the Anaheim f,ity Plan~ing Commission
does hereby grant, in part, subJect Petition for Variance, upon the following
condTtions which are hereby found to be a necessary prerequisite to the proposed use
of the subject property in order to preserve the safety and generai welfare of the
Citizens of the City of Anaheim:
t. That d~maged and/or hazardous siderialYs shall be repaired along Harbor
Boulevard as required by the City Engineer and in accordance w(th standard pians and
specifications on file in the Office of the City Engineer.
2. That subJect property shall be developed substantially in accordance
with plans and specifications on file with the Lity o` Anaheim marked Exhibtt Nos. i
and 2, provided, however, that no free-standing signs o[her than the existing one
shall be permitted.
3, That Condition Nos. 1 and 2, above mentioned, shall be complied with
prTor to final buildtng and zoning inspections.
