That no one indtcated their presence at said public hearing in opposi[ton; and that no correspondence was recelved in opposition to the subJeci pe[ition. ENViRONHENTAL IMPACT FINOING: Thax [he Anaheim Ctty Planning Commissio~i has reviewed t e proposa to expand a retirement home on a rectangularly-shaped parcel of land consisting of approximately 10 acres loca[ed at the northwes[ corner of Ball Road and Walnut Street, havtng approximate frontages of 716 feet on [hc north side of Ball Road and 6pg feet on the west sfde of Walr.ut Stree[; and does hereby approve the Negative Dec~aration from the require.^ien[ to prepare an environmentrl Impact report on the basis that there Nould be no significant indlvidual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subJect property for lox de.isity residential land uses commensurate with the proposal; that no sensittve environmental impacts are Involve~ in the proposai; that Lhe ~ni[tal Study submitted by the petitioner indicates no signlficart individual or cumulative adverse environmen[ai impacts; and that Che iiegative Deciaration substantiating the foregofng f(ndfngs {s on flle in Lhe City of Anaheim Planning Department. NOa~ THEREFORE, BE IT RESOLVED Cha[ the Anaheim City Planning Commisslon does hereby grant subjec[ Petition for Conditional Use Permit, upon the following conditions Nhlch are hereby found to be a necessary prerequisite to the proposed use of the subJect property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1, That Lrash storage areas shall be provlded in accordance with approved plans on file with [he Office of the Director of Public Works. 2, 7hat the owner{s) of the subJect p~operty shall pay the traffic signal assessment fee (CouncTl Pollcy No. 214) amounti~g to $363.00 per 1000 square feet of butlding or fractlon thereof prior to the issuance of bullding permtt. -2- PC78-t67 ,, . 3, That subJect preperty shall be dev~loped substarttlally in accordance with plans and specificatlons on file with the City of Anaheim marked Exhtbit Nos. 1 through 4. ~. BE IT FURTHER RESOLVED that the Anahelm City Planning Commlssion does hereby flnd and determine that [he adoptlon of this Resolution Is expressly predtcated upon applicant's compllance with each and all of the conditions hereinabove set forth. Should any condition or any part thereof, be declared invalid or unenforceable by the finai judgment of any court of competent Jurisdictlon. then this Resolution, and any approvals herein contained, shall be deemed null and void. 1978.
