PC 78-1$ RESOLUTION OF THE ANAHEIM CITY PLA~INING COH~ISSION TffAT PETITION FOR VARIAqCE N0. 2987 BE GR~NTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Variance from K1~1 RICHARDSON AND LYNN E. TH0~1SE~l~ 71~ ~~. Euclid 5[reet,~220. Anaheim, California 92801 (owners) of cer*.ain real property situated in the City of Anaheim~ County of Orange. State of California, described as: Proposed Parcel Map R.S.T. NO.------- being a subdivision of the folloriin9: 7hat portion Section 9, in Township 4 South, Range 10 West, San Bernardino Base and Meridtan, described as follows: Parcel 2 as shwon on a map filed in Book 100, page 28 of Parcel Map. Together with the appurtenant interest in the well, pumping plant, rights of a+ay and pipe Iine used in furnishing water to the above described land from the water ~•ell now located on a part of Lot ~ in Section °, Township 4 South, Range t~ West, San Bernardino Base and Meridian, as per map thereof recorded in book 1, at page 5E, of Record of Surveys, in the offfce of the Councy P.ecorder of said Orange County, as conveyed in a deed dated July 13, 1927 from Citizens Trust and Savtngs Bank, a corporation, to S. H. Whisnant, and wife, recorded August Q, 1q27 in Book 77, at page 34 of Official Records, in the office of the County P,ecorder of said Oran9e Lounty. WHEREAS, the City Planning Commission did hold a public hearing at the City Hail in the City of Anaheim on January 3~, 197II, at 1:3~ P.m., notice of said public hearing having been duly 9iven as required by law and in accordance with the provtsions of the Anaheim Municipal Lode, Chapter 18.03, to hear and consider evidence for and a9ainst said proposed variance and to investi9ate and make findings and recommendations in connection [herer+ith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of aii evidence and reports offered at said hearing, does fi~d and determine the following facts: 1. That the petitioner proposes a waiver of the following to establish a 2-lot RN-1200 subdivision: SELTIOtI 18.3-+.061.020 - Minimum buildin stte width. 0 eet requ re ; 1~ eet proposed). 2. That the pro~osed waiver is herehy granted on the basis of the subst~nttally greater depth of subject property compared with other nearby parcels (274 feet compared with approximately 15~ feet for the other proper[ies) and bPCause the "panhandle" of the narrow frontage lot will be utilized for driveway purposes and witl not be developed with any bulldings; and, furthermore. that said "panhandle" will be part of a common driveway easement between Parcels A and B, as shown on Exhibit 1. and petttioner stipulated to providin9 comnon ingress and egress agreements for both parceis. That there are exceptional or extraordinary circumstances or conditions applicable to [he property involved or to the intended use of the property that do not apply gener~lly to the property or class of use in the same vicintty and zone. 4. That the requested varlance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in questlon. 5. That the requested variance will not be matcrially detrimental to the public welfare or inJurious to the property or improvements in such vicinity and zone in which the property is located. 6. That no one indicated their presence at said pubtic hearing in opposition; and that no correspondence a~as received in opposition [o the subJect petition. E~7VIRONMENT~L IMPACT FINDING: That the Anafieim City Planning Commission has reviewed the subJect proJect, consisttng of ~ 2-lot RM-1200 suhdivision with waiver of minimum building site width on an irregularly-shaped parcel of land consisti~g of approximately 0.7 acre located at the cul-de-sac terminus of Lido Place, having a frontage of approximately 141 feet on the south side of Lido Ptace, having a maximum depth of approximately 3~~ feet and being located aDProximately 37~ feet east of the centerline of Lido Lane; and does hereby approve the Negative Declaration from the requirement to prepare an environmen[ai impact report on the basis that there would be no significant individual or cumulattve adverse environmental impact due to the approval of this Negative Declaration since the Anaheim Generai Pian designates the subJect property for medium densi[y residential land uses commensurate with the proposal; that ~o sensitive environmental impacts are invoived in the proposal; that the Initial Study submit[ed by the petitioner indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantlating the foregoing flndings ts on file in the City of Anaheim Planning Department. NON, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby 9rant subJect ?etition for Variance, upon the followirtg cortdlttons which are hereby found to be a necessary prerequisi[e to the proposed use of the subject property in order to preserve tfie safety and general welfare of the Citizens of the C i ty of Anahe irn: i, That subject property shall be developed substantially in accordance with plans anJ speci£ications on file with the Ci[y of Anahei~ marked Exhiblt Nos. 1 through 5. 2. I~ the event [hat subject property is to be divided for [he purpose of sale, lease, or financing. a parcel map, to record the approved divisio~ of subJect property, shall be submitted to and approved by the Cicy of Anaheim and then be recorded in the office of the Orange County Recorder.
