WHEREAS. the Anahelm CTty Planning Commission did receive a verified

WHEREAS, the C3ty Planning Commission did hold a public hearing ai the City
Hall in the City of Anaheim on Juty 31. 1978. at 1:30 p,m., notice of said publTc
hearing having been duly glven as required by law and in accordance with the
provisions of the Anahefm ~iunlcipal Cede, Chapter 18.03, Co hear and consider
evidence for and against satd proposed conditlonal use and [o investigate and make
findings and reconmendations in connectlon therewtth; and
WHEREAS~ said Commission~ after due Tnspectlon, investigatTon and study made
by itself and in its behalf, and after due consideratlon of all evidence and reports
offered at said hearing, does find and determine the following facts:

1. That the proposed use ls properly one fo~ whlch a conditional use
permTt ls authorized by Anaheim Munlcipal Code Sectlon 1E.61.050.503 to wit: to
expand a truck terminal.
2. That the proposed use will not adversely affect the adJolning land uses
and the growth and development of thc area in Nhich ~t is proposed to be located.
3, That the size and shape of the site prooosed for the use is adequate to
allow the full development of the proposed use in a manner r~ot detrlmental to the
partlcular area nor to the peace, health, safety, and general welfare of the Citizens
of the City of Anaheim.
4, That the granting of the Conditional Use Permit under [he conditions
imposed, ff any, wil) not be detrimental to the peace, healtti. safety and general
welfare of the Cttizens of the City of Anaheim.
5. That no one tndicated their presence at said public hearing in
opposition; and that no correspondence was received in oppositfon to the subJect
petition.
ENUIkOt~MENTAL IMPACT FIlIDING: That the Anahetm City Planning Cormnission has
reviewed the proposal to expand a truck termina) on a rectantularly-shaped parcel of
land consisting of approximately 1.8 acres located at the cul-de-sac terminus of
Grove Stree[, having a frontage of approximately 114 feet on the north sfde of Grove
Street, having a maximum depth of approximately 400 feet, being locaced approximately
750 feet south of the centerline of La Palma Avenue; and dor_s hereby approve the
Negattve Dectaration from the requirement [o prepare an environmental impact report
on the basis thac there would be no significant indivtdual or c~mulative adverse
envTronmental lmpact due to the approval of this Nega[ive Deciaratlon since the
Anaheim General Plan designates the subject property for general industrlal land uses
commensurate with the proposal; that no sensitive environmen[al Impacts are involved
in the proposai; that the Inittal Study submitted by the petitloner indtcates no
significant indivtdual or cumulative adverse environmental impacts; and t~at the
Negative Declaration substantiating [hc foregoing findings is on file in the City of
Anahe)m Planning Department.
NOW~ THEREFORE, BE IT RESOLVED tha[ the Anaheim City Planning Commission
does hereby grant subject Petition for Conditionai Use Permit, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed use
of the subJect prooerty in order to preserve the safety and general welfare of the
Cttlzens of the City of Anahelm:
1, That fire hydrants shall be installed and charged as required and
determined to be necessary by the Chief of the Fire Department prior to the
cornnencement of structural framing.
2. That the owner(s) of subJect property shall pay the traffic signal
assessment fee (Council Poticy No. 21A) amounting to $30.00 per 1000 square feet of
the new building or fraction thereof prlar to the issuance of a bullding permit.
3. That subJect property shail be devetoped substantially in accordance
wi[h plans and specifications on file wltfi the City of Anaheim marked Exhibit No. i.
BE IT FURTHER RESOLVED that the Anaheim City Planni~g Commtssion does hereby
find and determine that adoption of this Resolutlon Is expressly predicated upon

applicant~s compliance with each and all of the conditions herei~above set forth.
Should any such condition, or any part thereof~ be declared invalid or unenforceable
by the flnal judgment of any court of competent Jurlsdictlon, then thts Resolutlon,
and any approvals herein contained, shall be deemed null and void,
