1~1HEREAS~ the CTty Planning Commission did hold a public hearing at the Clty
Hall ln the Clty of Anaheim on Ju1y 31, 1978, at 1:30 p.m,~ notice of satd public
hearing having been duly given as required by law and in accorda~ce with the
provisions of the Anaheim Municipal Code. Chapter 18.03, to hear and consider
evidence for and against said proposed conditional use and to investigate and make
findings and recommendatlons in connectlon thereaith; and
WHEREAS~ said Commisslon, after due inspectTon. investigation and study made
by itself and i~ its behalf~ and after due consideration of all evtdence and reports
offered at said hearing, does find and determine the following fac[s:
1. That the proposed use is properly one for ~rh(ch a conditionaf use
perrnlt is authorized by Anahelm Municipal Code Section 18.03.030.010 to Nit: To
txpand an automobile repair facllity with a walver of:

proposed bulldfng additlon wtll be used to house autcxnobTles [hat are currently being
parked on the undeveloped portton of the property walting to be repatred~ and that
evldence presented at the publlc hearing tndlcates the existing use does ~ot generate
sufficient traffic to warrant the number of parking spaces requlred by code. that the
denial would deprive this property of privileges enJoyed bY surrounding properties.
3. That the prc,posed use will not adversely affect the adJoinin~ land uscs
and the growth and development of the area in which It is proposed to be located.
k, That the size and shape of the site proposed for the use is adequate to
allow the full development of the proposed use ln a manner not detrimental to the

ENVIRONMENTAL IMPACT FINDING: That the Anahelm City Planning Commisston has
rev)ewed the proposa to expan an automobile repatr facTiity with waTver of minimum
number of parking spaces o~ a rectangularly-shaped parcel of land conststing of
approximately 0.2 acre having a frontage of approximately 98 feet on the north Hide
of Lincoln Avenue, having a maximum depth of approxtmately 102 feet, betng located
approximately 155 feet west of the centerline of Mest Street; and does hereby approve
the Negative Oeclaration from the reyuTrement to prepare an environmental impact
report on the basts that there aould be no significant individual or cumulative
adverse environmental impact due to the approval of this Negative Declaration since
the Anahetm General Plan designates the subject property for general commercTai land
uses commensurate with the proposal; that no sensieive environmental impacts are
invalved in the proposal; that the Inltial Scudy submitted by the petitioner
indtcates no significant individual or cumulatlve adverse environmental tmpacts; and
that the Negative Declaration su6sta~ilating the fortgoing findings fs on file in the
City of Anahetm Planning Department.
NOW, THEREFORE. BE IT RESOLVED that the Anaheim Llty Planning Cam~ission
does hereby grant subJect Petition for Conditional Use Permit. upon the following
conditloRS which are hereby found to be a necessary prerequisite to the proposed use
af the subject property in order to prescrve [he safecy and general welfare of the
Citizens of the City of Anahelm:
1. That the owner(s) of subject property shall pay the trafflc signal
assessmeat fec fur a comn~rciai use as estabifshed in connection wlth Councif Poltcy
No, 214, prfor to the Issuance of a bullding permit.
2. That subJecc property shati be developed substantlally in accordance
Nith plans and speciflcations on file wlth the City of Anaheim Marked Exhiblt Nos. 1
and 2.
BE IT FURTHER RESOLVED that [he Anaheim City Planning Commission does hereby
find and determine that adoptlon of this Resolutlon Is expressly predicated upon
appltcant's compliance wtth each and ail of the conditions hereinabove se[ forth.
Should any such condltlon. or any par[ thereof. be declared t~valld or unenforceable
by the ftnal judgment of any court of competent )urisdiction, then thTs Resotut(on.
and any approvals heretn contalned, shall be deemed null and void.
