PC 78-19 RESOLUTION OF THE ANAHEIM CITY PLANNING COMNISSION THAT PETITION FOR VARIArICE NO. 2~~9 BE GRAtlTEO 41HEREAS, the Anaheim City Planning Commission did recefve a verified Petition for Variance from SCOTT W. AND D~JNNA R/~MEY, 2537. Westport Drive, Anahetm, California, 92306, owners, of certain real property situated in the Clty of Anahetm~ County of Orange, State of Lalifornia described as: Lot 79 of Tract 3~!3E, City of Anaheim as per nap recorded tn book 132, pages 7 to 9 inclusive of Misceilaneous Maps. in the offfce of the Coun[y Recorder of said Orange County. WHEREAS, the City Planning Corriission did hold a public hearing at the City Hall (n the City of Anaheim on January 3Q, 1973. at 1:30 p.m., notice of said public hearing having been duly given as required hy law and in accordance with the provisions of the Anaheim Municipai Code, Chapter 18.~3, to hear and consider evidence for and againsi said proposed varfance and to investigate and make findings and recommendations in connectlon therewith; and WFiEREAS, said Cor;u~ission, af[er due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and deterr~ine the following facts: 1. That the oetitioner proposes a waiver of the followinq to consiruct a 3-car gara9e: SECTIONS 18.26.o63.n~o and 18.026.063.011 - Hinimurr, fron[-yard setback. 25 eei requ red; 20 eet and 2 i~proposed) 2. That the above-mentioned waiver is hcreby c~ranted on the basis that the petitioncr demonstrated that a hardship exists in that dcrtial w~ould be denying this property owner a privilege enJoyed by other property owners i~ the area, nearby lots having been developed with simtlar front setbacks that are less than 25 feet Tn depth. 3. That there are exceptional or extraordinary circums[ances or conditions applicable [o the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 4. That the requested variance is necessary for the preservation and enJoyment of a substantial property rlght possessed by other property in the same vicinity and zone, and denied to the property in question. 5. That the requested variance r~itl not be materially detrimental to the public rreifare or injurious to the property or improvements in such vici~ity and zone in which the property is located, 6, That no one lndicated their presenr,e at said publlc hearing in opposition; and that no correspondence was received i~ oppositton to the subject petition. ENVIRONMENTAL 14PACi FINDING: The Director of thc Planning Department has der.crmined that ihe praposed activity alls within the definttion of Section 3.01, Class 5, of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is. therefore~ ca[egorically exempt frrxn the requirement to file a~ EIR. NOW, THEREFORE. EE IT RESOLVED th~t the Anahetm City Planning Commission does hereby grant subJect Pe[ition for Variance~ upon the followin9 condTtion which is hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the Lity of Anaheim: 1. That subJect property shall be developed substantially in accordance with plans and specifications on file v+ith the City of Anaheim marked Exhibit No. 1.
