BAILEY, 1321 Simpson Circle, Anaheim, California 9Z&(16, agent-of certain real property si[uated in the City of Anaheim, Gounty of Orange, State of Lalifornia, described as: That portion of the Northwest quarter of Secticn 24, Twmship 4 South, Range 10 1Jest, in [he Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in book 51, paye 10 of tliscellaneous Maps, records of Oran9e County, Califo~nia, descrtbed as follows: Parcel No. 3 as shciwn on a Map filed in book a8, pages 2 and 3 of Parcel Maps in tlie ofFice of the County Recorder of Oranye County, California. WHEREI'S, the City Planning Commission did hold a public hearing at tfie City Hall in the City of Anaheim on August 14. 197Ei, at 1:30 p.n., notice of said public hearing haviny been duly given as required 6y law and in accordance with [he provisions of the Anaheim Municipal Code, Ghapter 1E.Q3, to hear and consider evidence for and against said p~oposed conditional use and to investigate and make findings and recommendations in connection therewith; and WiIEREAS, said Cor.mission, after due inspec[ion, investigation and study made by itself and in its bef~alf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the foltowing facts: 1. That the proposed use is properly one for which a conditional use permi[ is authoriza~ by Anaheim riuni:ipal Codc Section 18,03.030.010 to wit: to permit retail sales of furniture in the ML Zone. 2. That [he proposed use is hereby denied on the basis that it is a cortimercial use which would not be compati6le with the existing industrial uses; that approval would result in undesirable traffic generated by the general public being on the industrial streets, creating traffic and safety hazards; and that approvai would resul[ in a commercial inCrusion inio a wholly industrial area. 3, That the proposed use would adversely aFfect the adJoining land uses and the growth and development of the area in which it is proposed to be located. 4. That the size and shape of the site proposed for the use is not adequate to allow the full development oF the proposed use in a manner no[ detrimental to the particular area nor to the peace. health, safe[y, and general welfare of the Citizens of the City of Anaheim, 5, That the granting of the Conditionat Use Permit would be detrimental to the peace, health~ safety and general welfare of the Citizens of the City of Anahefm. ?G76-194 . i_' 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was recelved in opposit'ion to the subject petition. ENVORONHENTAL IMPACT FINDING: The Planning Director or his authorized representative has determtned that the proposed project falls within the defTnttian of Categorical Exemptions, Class 1. as defined in Paragraph 2 of the City of Anahetm Environmental Impact Report Guidelines and is, therefore, categoricaily exempt from the requiremen[ to prepare an EtR. NOW, THEREFORE, BE IT RESOLVED ihat the Anaheim City Planning Commission does hereby deny subject Petitton for Condttional Use Permit on the basis of the aforerr,antioned findings.
