WHEREAS, [he City Planning Cortmission did hold a pubtic hearing at the City Hall in the City of Anahetm on August 14, 1978, at 1:30 p.m., notice of said public heartng having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 1£i,03, to hear and cons(der evidence for and against said proposed conditional use and to investigate and make findings and recommendations In connection therewith; and WIIEREAS, said Commission, after due i~spection, investigation and study made by itself and in its behalf, and after due consideratio~ of all evidence and reports offered at said hearing~ does find and datermine the following facts: 1. That [he proposed use is properly one for which a condit+onal us~ permit is authorized by Anaheim Municipal Code Sectton 1$,b1,050.508 to wit: to pcrmit a tumberyard aiith waivers of: PC78-t95 ' (a) SECTfOtI 18.G1.060.013 - Minimum landsca ed setback. eet requ re ; 0 eet proposed) (b) SECTION 12.61.064.020 - Ma~imnm es^Permettct~wi[hin required setback areas; b fec[ proposed) , (c) SECTIOTI 18.61.068.030 - M;Zim~tsi[9 Senceosure required; eet proposed) 2, That the proposed waiver (a) is hereby granted, in part, waiving the required tandscaped setback alon9 Santa Ana ~treet only because existing Southern Pacific railroad tracks would separate the setback from the street and [he landscapin9 would not be visible from the street when railroad cars were present; and that the waiver is denied along [he other street frontages where 5-foot wide landscaped setbacks shall be provided except at the entrance gate. 3. That the proposed waiver (b) is hereby d~nied and al~ fencing shall be set back a minimum of 5 feet from adJacent public streets. 4. Tha[ [he proposed waiver (c) is herehy granted, in part, permitting 6- foot high fences along only the property lines which abut the other industrial properties and the Southern Pacific right-of-way at the northeast and southwest sides of the property; but in order to protect adjacenC and ~earby residential uses, 12- foot high chainlink fencing with wooden slats shall be provided to fully screen the stored lumber from Claudina, Sa~ta Ana and Ellsworth Streets; and that the 12-foot high fencing shail be extended approximately 10 feet easterly from Llaudina Street along the south property line, approximately 110 feet northerly from Ellsworth 5treet along the westerly property line, and approximately 100 feet nor[herly from Ellsworth Street along Olive Street. 5, That the proposed use. as granted, uill not adversely affect the adJoining land uses and the growth and de.velopmen[ of the area in which i[ is proposed to be located. 6. That [he size and shape of the site proposed for the use~ as granted, is adequate Co aliaw the full development of the proposed use in a manner not detrimental to the particular area nor [o the peace, health, safety, and general welfare of [he Citizens of the City of Anah~im. 7, That the Conditional Use Permit, as granted, and under the conditTons imposed, will not be detrimental to the peace, health, safety and general welfare of the Litizens of [he City of Anaheirn. 8. E~lVIP.ONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the proposa to permit a umberyard with waivers of minimum landscaped setback~ maximum fence height, and minimum site screening on an irregularly-shaped parcel of land consisting of approxima[ely 3.2 acres, having approximate frontages of 140 feet on the north sidc of Ellsworth Street, 405 feet on the south side of Santa Ana Street, and 150 feet on the east side of Claudina Street, and 130 feet on the -2- PC78-195 Hest side of Olive Sfreet; and does hereby approve the Ncaative Declaration from the requirement to prepare an e~vironmental Impact report on the basis that there would be no signiflcant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designatcs the subJect property for general industrial land uses commensurate with the praputal; that no sensttive environmental Impacts are involved in the proposal; that the Initial Study submttted by the petitioner Indlcates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantlating the foregoing find(ngs is on file In the City of Anahetm Pianning Department. NOW. THEREFORE. BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant, in part, subJect Petitlon for Londitional Use Permit. upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1, That street lighting facilities along Olive, Claudlna and Ellsworth Streets shall bc installed prlor to the final building and Zoning Inspectlo~s unless otherwise approved by the Director of Public UtilitTes, and in accordance with standard specifications on file in the Office of the Director of Public Utilitles; a~d/or that a bond~ certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim shail be posted with the City to guaran[ee the Installatlon of the above-mentioned requirements prior to occupancy. 2, Tha[ the owner(s) of subJect property shall pay to the City of AnaheTm the sum of three and one-half dollars (53.50) per front foot along Santa Ana Street for street li9hting purposes. 3, That sidewalks shall be instatled atong Claudina Strcet and Ellsworth Street as required by the Cit; Engineer and tn accordance w(:h standard plans and specifTcations on file in the Office of che City Engineer. 4, That the owner(s) of subject property shall pay the traffic sTgnal assessment fee for tndustrlal buildinas (Council Polfcy No. 2S4) prior to the issuance of a building permit. 5, 7hat subject property shall be developed substantially in accordance with plans and specTficatlons on fTle with the City o` Anaheim marked Exhibit No. 1; provTded, however, that the 5-foot required landscaped setback shalt be ~rovlded along Claudina.
