State of Lalifornia, described as: Lots 4 and 5 of Tract No. 658, as per Map recorded in book 20, page 35 of Misceilaneous Maps in the office of the County Recorder of saTd County. Except that portion thereof as granted to the State of Californfa by Deed recorded July 11, 1955 in book 3133, page 1? of Official Records. WNEREAS, the City Planning Lommission did hold a public hearing at the City Hall tn the City of Anaheim on August 2$, 1978, at 1:30 p.m., nottce of saTd publTc hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Lode. Chap[er 18.03, to hear and consider evidence for and agatnst said pr~posed condittonal use and to tnvestigate and make findings and recommendatlons in connection therewith; and WNEREAS. said Commisslon. after due tnspectlon, investlgation and study made by Itself and in its behalf, and after due considera[ton of all evidence and reports offered at said hearing, does find and determine the follrn~ing facts: i. That the proposed use is properly one for which a conditio~al use permit is authorized by Anaheim Municipal Codc Secclon 18.03•030.010 to wit: to permit a motorcycle sales and repair facllity. 2. That the proposed use is hereby granted and that the hours of operatton shatt typically be 10:00 a.m, to 5:06 p.m., Honday [hrough Friday. with a maxim~ur of 5 employees. ' 3. That the proposed use will not adversely affect the adJoining land uses and the growth and de~elopment of the area tn which it Is proposed to be tocated. 4. Tha[ the size and shape of the stte proposed for the use is adequate to allow the fult development of the proposed use in a manner not dctrimentai to ihe particular area nor to the peace, health, safety, and general welfare of the Cttizens of the City of Anaheim. 5. That the granting of thc Conditional Use Permit under the condttions imposed, if eny, will not be detrimental to the peace, health, safety ard general welfare of the Cltizens of the City of AnaheTm. 6, That no one indicated thelr presence at sald public hearing in opposTtlon; and that no correspondence was recelved in opposltion to the subJect petition. ENVIRON~~ENTAL IMPACT FINDING: The Planning Director or his authorTzed representat-l~ve has dete m ned that the proposed project falls within the definltion PC78-201 of Categorical Exemptions, Class 1, as defined in Paragraph 2 of the City of Anahcim Environmental Impact Report Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. NON, THEREFORE~ BE iT RESOLVED that the AnaheTm City Planning Commission does hereby grant subJect Petltion for Conditional Use Permit. upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subJect property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: i. That subJect property shall be developed substantially in accordance with approved plans and spectficattons on file with the City of Anahelm marked Exhibit Nos. 1 and 3. BE IT FURTHEP, RESOLVED that the Anaheim Ctty Plannin9 Commission does hereby ftnd and determine that adoption of this Resolution is expressly predicaYed upon applicant's comptlance with each and all of the conditions hereinabove set forth. Should any such condition, or any pa~t thereof~ be declared invalid or unenforceable by the final Judgment of any court of competent Jurisdlction, then this Resolution~ and any approvals t~erein contatned, shall b~ deemed nuTl and void.
