WHEREAS, the City Planning Commission did schedule a public hearing at tfie City Hall !n the City of Anahetm on July 3, 1978, at 1:30 P.m., notice of said public hearing having be~n duly 9iven as required by law and in accordance with the provlsions of the Anaheim Municipal Code, Chapter tII.03, to hear and conslder ev(dence for and agalnst said proposed reclassification and to inves[igate and make ftndings and recommendations in connection therewith; saici public hearing having been continued to [he Planning Commtssion me~ting of August 28, 1978, at 7:00 p.m,; and NHERE115, said Commission after due inspectian~ i~vestigation and study made by iiself and in its behalf, and after due considcration of all evidence and reports offered at said hearing, does find and determine the followin9 facts: i, That the peti[ioner proposes reclassificatton of subject property from the R5-A-43,000 (SG) (Reside~tial/Agricultural-Scenic Corridor Overlay) and County A-t (General Agricultural) Zones to the RS-HS- 10,000(SC) (Resldential, Single-Far..ily-N(liside-Scenfc Corrldor Overlay) Zone, 2, That the Anaheim General Plan designates subject property for low-density residential land uses and general open space. 3. That the proposed reclassificatcton of subJect property is necessary and/or desirable for th:: orderly and proper development of the cortvnunlty. ~, That the proposed reclassiftcation of subjec.~ property does properly relate to the zones and thetr permitted uses locally established in close proximity ta subject property and to the zones and their permitted uses generally estabilshed throughout the communtty. 5. That the proposed reclassification of subJect property requires the dedication and tmprevement of abutting streets tn accordance with the Circulation Element of the General Plan, due to the antl~tpated increase in traffic which will be generated by the intensificatton of land use. -2- PC78-208 'i 1^ ! '. ! 6. That approximately 64 persons indicated their presence at said pub)tc hearing in opposition; and that no correspondence was received in opposition to the subJect petition. ENVIRONMENTAL IMPACT FINDING: That thc Anahetm City Planning Conmission does hereby n that IR t~o. 21 or the proposed development of Tentative Tract Nos, 10407, 10408, 10409 and 10410, consisting of ili~~ single-f.amity homes, having been considered this date by the Anaheim City Planning Ca~mission and evidence, both written and oral, having been presented to supplement draft EIR No. 21(i, finds that potential proJect-generated envlronmental imoacts have been reduced to an acceptable level by conformance with City plans, policies and ordinances and draft EiR No. 218 is in conpllance with the Callfornla Envtronm~ntai Quality Act anc! City and State Guidelines; therefore, based upon such fnformation, the Anahetm Ctty Planning Commission does hereby certtfy Eift No. 218. I~OW, THEREFORE, BE IT RESOLVED that the Anaheim City Plann(ng Comrnlssfon does h~reby grant subJect Pe[ition for Reclassification and, by so doing, that Title 1$-Zoning of the Anaheim 1lunicipai Code be amended to exclude [he above-described property from the RS-A-43,000(SC) (RESIUENTIAL/AGRILUL?URAL-SCENIC CORRIDOR OVERLAY) and County A-1 (General Agriculturai) Z~NES and to incorporate sald described property into [he RS-HS-10,00(SC) (RESIDEt~TIAI, SIHGLE-FNIILY-HIILSIDE SCENIC CORRIDOR OVERLAY) 20NE upon the following conditions which are hereby found to be a necessary prerequis(te to [he proposed use of subject property in order to oreserve the safety and general welfare of the CJiizens of the C{ty of Anaheim: 1. That ftre hydrants shall be installed and charged, as requlred and determined [o be necessary by the Chief of the Fire Department, prior to commencement of structural framing, 2. That subJect property shall be served by under9round utilities. 3. In the even[ that subjec[ ~roperty is [o be divided for the purpose of saie, lease or financing~ a parcel map, to record the approved division of subject property, sha)i be submitted to and approved by the City of Anaheim and then be recorded in the Offtce of the Orange County Recorder. 4, That the owner(s) of subject property shal; pay to the City of Anaheim the appropriate park and r~creation in-licu `ees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 5. That these reclassification proceedtngs are granted subject to completlon of annexation of subject property Co the City of Anahelm. 6. That the ordinances rezoning [he subjec[ property shall in no event become effective except upon or foliowtng the recordatio~ of each of the final Tract Map Nos. 1040~, 10408, 10409 and 10410 within th2 time specified in Government Code Section 66463.5, or such further time as the advisory agency or City Louncil may grant. 7. That the developers of subject property shall pay the trafffc signal assessment fee (Council Policy No. 214) amounting to $36,00 per each new dwelling unit prior to the issuance of a building permit. Should any such conditton, or any part thereof, be declared invalid or unenforceable by the final Judgment of any court of competent Jurisdiction, then this Resolutton, and any approvals herein contained, shall be deemed null and void.
