WHEREAS, [he Anaheim City Planning Commission did receive a verified petitlon for Rec.lassification from ELAINE B. L04JRY, WILLIAM J. STEINBORN At1D JOHN C. STEIPlBORPI, JR., 1008 East Broadway, Anaheim, California Q2805, owner~ and JAMES L. BARISIC, 825 South Western Avenue, Los Angeles, Catifornfa 90022, aqent, of certain real property sltuated in the City of Anaheim, County of Orange, State of California, described as fol'ows: Lots 2 and 3 in Dlock E, Lorelei Trac[, in the City of Anaheim~ as sho~m on a map thereof recorded in book 29, page 24, Miscellaneous Records of Los Angsles County, California. WHEREAS, the City Planning Cortsmission did schedule a public hearing at the City Hall in the Cfty of Anaheim on August 28, 1978, at 1:30 p.m., notice of said public hearing havtng been duly given as required by law and in accorda-+ce with the provtsions of the Anaheim Municipal Code, Chapter 18,03, to hear and consider evtdence for and against said proposed reclassification and to investigate and make findings and reco~suunendations in connection therewith; said public hearing having been continued to the Planning Commission meeting of September 11, 197$; and WHEREAS, said Commission after due inspection, investigation and study made by itself and in its bchalf, and after due consideration o4 all evidence and reports offered at said hearing, does find and de[ermine thc followTng facts: 1. That the petitioner proposes reclassification of subject property from the RN-240Q (Residential, Multiple-family) Zone to the RM-1200 (Residential~ 1lultipie-Family) Zone. 2. That the Anaheim General Pian designates subiect pro~erty for medium- density restdential land uses. 3, That the proposed reclassf`icaLion of subJecL properLy is rtecessary and/or desir~ble for the orderly and proper development nf thc community. k. That the proposed reclassificatlon of subJect properiy does properly relate to the zones and [heir permlt[ed uses locally established in close proxtmity to subJect property and to the zones and their permitted uses generally established throughout Lhe cormunity. 5. That the proposed reclasstftcation of subJect property requlres ths dedication and improvement of abutti~g streets in accordance with the Ctrc~la[ion E?ement of the Gensral Plan, due to the anticipated i~crease in traffic which will be generated by the intensification of land use. 6. That no one indicated their presence at said p~blic heartng in oppositlon; and that no correspondence was received in opposition to the subject petition. EI~VIRONMENTAL IMPACT FINDING: That the Anahetm City Planning Commtssion has reviewed thc praposal to reclassi y subject property from the RM-2400 (Resfdential~ PC78-212 i f MultTple-Family) to the RM-1200 (Residential, Multiple-Family) Zone to construct a 10-unit apartment complex on a rectangularly-sfiaped parcel of land consisting of approximately 0.3 acre, having a frontage of appraximately 100 feet on Yhe south side of Broadway, havin9 a maximum depth of approximately 134 feet, being locat~d approximately 80 feet east of the centerline of Bush Street; and does hereby approve the Negative Declaration from the requirement to prepare an environmental Tmpact report on the basis that there arould be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan desi9~ates the subJect property for medium-density residential land uses commensurate with the proposal; that no sensitive envtronmental impacts are invalved in the proposal; thai the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmentat impacts; and that the Negative Declaratio~ substanttatTng the foregoing findings (s on file In the City of Anaheim Ptanntng Departmen[. NOW, THEREFORE, BE IT RESOLVED that the Anaheim Ct[y Planning Commission does hereby grant subJect Petition for Reclassification and, by so doing, that Titte 18-Zonin9 of the Anaheim Municipal Code be amendPd to exclude the above-described property from ihe RH-2400 (RESIDEtlTIAL. MULTIPLE-FAMILY) ZONE and to incorporate said described property into the RM-1200 (RESIDENTIAL, MULTIPLE-fANILY) ZONE upon [he following conditions which are hereby found to be a necessary prerequisite to the proposed use of subJect proper[y in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That trash storage areas shall be provided in accordance with approved ptans on file with the office of the Director of Public Works. 2. That the owner(s) of subject property shall pay the ~raffic signal assessment fee {Council Policy No. 214) amour.tin9 to $36.00 per each new dwelling unit prior to the issuance of a building permit. 3. Thai Conditlon No. 1, above-mentiuned, shall bc complied with prlor to final building and zoning inspections. BE IT FURTHER RESOLVED that the pnaheim CTty Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance wtth each and all ef the cond(tions herelnab~ve set forth.
