public hearing havin9 been duly given as required by lar+ and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 18.Q3, to hear and consider
evidence for and against safd preposed conditional use and to investigate and make
findings and recommendatio~s in co~nection therewith; and
WHEREAS~ said Canmission. after due inspection, investigatlon and study made
by (tself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the foltowing facts:

1. That the proposed use is properly one for which a condTtional use
permit is authorized by Anaheim Municipal Code Section 18.03.030.010 and
18.61.050.390 to wit: to permit business offices and restaurants in an industrfat
complex.
2. That the proposed use is hereby granted subJect to review and approval
of the specific plans by the Planning Commtssion. Said plans must indicate adeG~ate
parking spaces being provtded for each individual buildin9 tn the proJect and
indicating adequate intertor circulation to insure adequate turn around area for
large vehicles as ~pproved by [he City Traffic Engineer; and further indicate
adequate trach enclosures being provided for each individual unit as approved by the
Sanitatlon Division.
3. That the proposed use wfli not a~versely affect the adJotning land uses
and the growth and developmen[ of the area in which it is proposed to be located.
4. That the size and shape of the site proposed for the use is adequate to
ailow the full development of the proposed use in a manner ~ot detrimen[al to the
particular area nor to the peace, health, safe[y, and general welfare of the Citizens
of the City of Anaheim.
5. Tha[ the granting of the Condttional Use Permit under the conditions
imposed, if any, will no[ be detrimental to the peace, health, safety and general
welfare of thc Citizens of thc City of Anaheim.
6. That no one indicated their presence at satd public hearing in
opposition; and thac no correspondence was recetved in opposition to the subject
petition.
ENVIRONHENTAL IMPACT FINDING: That the Anaheim C1;y Plannina Commission has
reviewed the subject proposa to permit busi~ess offices and restaurants in an
industrial compier on an irreguSarly-shaped parcel of land consisting of
approximately 27.8 acres, havi~g a frontage of approximatcly 707 feet on the east
side of Magnolia Avenue, having a maximum depth of approximately 1650 feet. being
located approximately 515 feet north of [he centerline of La Palma Avenue; and does
hcreby approve Lhe !~egattvc Declaraiion from thc reGuirement to prepare an
environmental impact report on the basis ihat there would be no significant
individual or cumulative adverse environmental impact due to rhe approval of this
Negative Declaration since the Anaheim General Ptan designates the subject property
for general i~dustriai land uses commensurate with the proposal; that no sensitive
envTronmental impacxs are involved in the proposal; that the Initial Study submitted
by the petitioner indicates no signiftcant individual or cumulative adverse
environ~entai impacts; and that the Negative Declaratlon substantiating the foregoing
ffndings is on file in the City of Anahetm Planning Department.
NOW~ TNEREFORE. BE IT RESOLVED that the Anaheim City Planning Lommission
does hereby grant subJect Petition for Condicional Use Perrni[~ upon the following
condittons wh(ch are hereby found to be a necessary prerequisite to the proposed use
of the subject property in order to preserve the safety and general welfare of the
Citizens of the City of Anaheim:
1. That public utility easements shatl be dedicated to the City of Anaheim
as requlred by the Directo~ of Public Utilities.

2. That the owner(s) of subJect property shall pay the trafflc slgnal
assessment fee (Council Policy No, 214) amouniing to 5180.00 per 1000 square feet of
the restaurant and office buildings and 53~.00 per 16D0 sauare feet of industrfal
buildTngs or fractton thereof prlor to the issuance of a building permit.
3. That the fire access casement located on the easterly portlonof sub)ect
property shall be approved by the City Attorney's Office and then bc filed and
retorded in the office of the Orange County Recorder,
4. That the traffic signal located at Woodland Drive shall be modifled
subJect to the approval of the City Trafftc Engineer.
5. That trash sto~age areas shall be provided in accordance wtth approved
plans on ftle wlth the office of [he Direc[or of Publlc uorks.
6. That subject property shall be developed substantially in accordance
with plans and speciflcations on file with the City of Anaheim marked Exhibit Nos. i
through 3.
7. That speciFic plans shall be submit[ed to the Plannina Cammission for
review and approval.
S. That Co~dltion Nos. i, 3, 4 and 7, above-mentioned~ shell be compit~d
wi[h prtor to the commenceeient of the activity authorized un~er this resolucion, or
prior to the time chat the 6uilding permit is issued~ or within a period of one year
from date hereof, ~hichever occurs first, or such further time as the Pianning
Commission may grant.
9. That Condi[ton Nos. 5 and 6. abovc-mentioned, shall be complied with
prior to final building and zontng inspections.
BE IT FURTHER RESOLVED that the Anahelm City Planning Crnnissio~ does hereby
find and deternine Chai adoption of this Resolution is expressly predicated upon
applicant's compliance with each and ali of the conditions hereinabove set for[h.
Should any such condition, or any par[ thereaf, be declared Inva]id or unenforceable
by the fina( fudgment of any court of competent jurisdiction~ then ti~is ~csaiution,
and any approvals herein contained, shail be deemcd nul) and votd.
