WHEREAS, the Anaheim City Plannin9 Commission did receive a verified
petition for Reclassification from YCUNG F. AND LUCItIDA J. HAt1i1ATT, t543 West
Orangewood Avenue, Anaheim, California 92802, owners, and JOHN F. SWINT, 707 West
North Street, Anaheim, California 92805, agent, of ccrtain real property situated in
the City of Anaheim, County of Orange, State nf California, described as follows:

WHEREAS, the City Planning Commission did schedule a mubi'noticeinofatsaid

WHEREAS, said Commission after due inspection, investi9ation and study made
by itself and i~ its behalf, and af[er due consideration of all evidence and reports

~, That the petitloner proposes reclassifica[ion of ~ubJect property from
the R5-A-43,000 (Residentiat/Agricuitural) to the RS-7200 (Residential. Singie-
Family) Zone.

density residential land uses.

and/or desirable for the orderly and proper development of the community.

throughout the cortmunity.
5. Tha[ the proposed reclassification of subject proper[y requtres the
improvement of abutting s[reets in accordance wtth the Circulation Element of the
General Plan, due to the anticipated increase in traffic which will be generated by
the intensification of land use.
6. That no one indica[ed their presence at said public hearing in
opposiiton; and that no correspondence was received in oppositton [o the subJect
petition.
ENVIRONNEPITl1L IMPACT FINDING: That the Anaheim C(ty Planning Commission has
reviewed the proposa to rec ass fy subject property fron the RS-A-43,000
(Residentlal/Agricul[ural) to the RS-7200 (Residential, Single-Famtly) zone [o
establlsh a 7-lot, RS-7200 subdivision with Haivers of requlrement that all lots abut
a publfc street, minimum lot width and frontage and the requirement that single-
family residences rear-on arterial highways on an irregularly-shaped parcel of land
consisting of approximately 1.6 acres, having a frontage of approximately 27.4 feet on
the south side of Orangewoocf Avenue, having a maximum depth of approximately 303
feet. being located approximately 52o feet west of the centeriine of Ninth Stree[,
and does hereby approve [`~e lde9ative Declaration from the requlrement to prepare an
environmenta! Impact repor[ on the basis that there would be no significan[
ir.diviJual or cumulative adverse envlronrnental impact due to the approval of thts
Negative Oeclaration since the Anaheim General Plan dest9nates the subject property
for low-density resfdential land uses commensuratc with the proposal; that no
sensitive environmental inpacts are involved in the propos~l; that the Initial Study
submitted by the petitioner indicates no significant individual or cumulative
adverse environmentai impacts; and that [he Nega[ive Declaration substan[iating the
foregoing find(ngs is on file in [ne City of Anaheim Planni~g Depart~~ent.
NOW, THEREFORE, BE IT RESOLVED that the Anahelm City Plannln9 Cortmisston
does hereby grant subject Petition for Reclassification and, by so doing, that Title
16-Zoning of the Jlnahelm Hunicipal Code be amended [o exciude the above-descrfbed
property from tMe RS-A-43,000 jRESIDENTIAL/AGRILULTURAL) ZONE and to incorporate said
described property into the RS-7200 (RESIDE~ITIAL, SINGLE-FAHILY) ZONE upon the
following conditfons which are hereby found to be a necessary prerequtsite to Che
proposed use of subject property tn order to prescrve the safety and general welfare
of the Citize~s of the CiCy of Anaheim:
1. Tha[ street lighting facillties along Orangewocd Avenue shall be
installed prior to final buliding and zoning inspections unless otherwise approved by
the Director of Public Utilfties, and in accordance wlth s[andard spectfications on
fite in the office of the ~irector of Public Utili[ies; and/or that a bond,
certificate of deposit, letter of credit, or cash, in an amount and form satisfactory
to the City cf Anaheim, shali be posted wtth the City to guarantee the installatlon
of the above-mentioned requlrements prlor to occupancy,
2. That subJect property shall be served by underground u[ilities.

3. That drainage of subject property shall be disposed of in a nanner
satisfactory to the Lity Engineer.
4. That [he owner(s) of subject property shall pay to the City of Anaheim
the appropriate park and recreation in-lieu fces as determ(ned to be appropriate by
the City Counctl, said fces to be paid at the time the building permit ts issued.
5. An ordinance rezontno the subject property shall in no event bacane
effective e::cept upon or followtng the recordation of a final tract map approved by
the City Council.
6. That all private streets shall be developed in accordance with the City
of Anahelm's standards for private streets.
7. ThaL fire hydrants shall 6e installed and charged, as required and
determined to be necessary by the Chief of the Fire Department, Frior to commencement
of structural framtng.
8. That the owner(s) of subject property shaii pay the resldentlal traffic
signal assessment fee (Council Policy No, 214} amounting to 536.00 per each new
dwelling unit prior to the issuance of a building permit.
9. Prior to the introduction of an ordinance rezoning subject property,
Condition Nos. 1 and 5, above mentioned, shall be completed, The provisions or
rights granted by this resolution shall become null and void by actlon of the
Planning Lommission unless said conditions are complied w(th within one year from tfie
date hereof, or such further time as the Planning Comnission may grant.
10. That Condition Nos. 2, 3 and 6, abovc mentioned, shali be complied wi[h
prior to final bullding and zonin9 inspections.
BE iT FURTHER RESOLVED that the Anaheim City Planning Commtsslon does hereby
find and determine that adopiion of this Resolution ts expressly predicated upon
applicant's compliance with each and ali of the condittons hereinabove set forth.
5hould any such condition, or any part thereof, be declared invalid or unenforceable
by the fina,l judgment of any caurt of competent Jurisdictton, then this Resolution,
and any approvals hereln contained, shail be deemed null and void.
