WNEREAS, the Anaheim City Planning Commission did receive a verifted petitlon for Rer.lassification from ROOBIE Y~UFMAN At~D JAMES NORMP.N MORf,AN, 3~~ ~outh Harbor Boulevard, Suite 51a, Anahetm, California 92305, owners, of certain real property situated in the City of Anaheim, County of Orangc, State of California, described as follows: Beginning at ihe Northwesterly corner of Block 8 of a replat of the Orchard Park Tract, as shown on a Map recorded in Book 7, page 6 of Miscellaneous Maps, records of Orange Lounty, California; thence Easterly along the Northerly line of said dlock, 249.75 feet; thence Southerly parallel to the Wes[erly tine of said eloclc a,229•5 feet; thence Westerly parallel rrith the Northerly line of said Block 24Q.75 feet to the WPSterly line of said Dlock; thence Northerly along the Wesierly line of satd Block 8, 22°.5 fee[ to the placc of beginning. Excepting therefrom the Nor[herly 3~ feet of said land as conveyed to the Lity of Anaheim, a Municipal corpora[ion, for road and incidental purposes, by an instrument dated Oc[ober 11, 1?12 and recorded December 9, 1°12 in Book 224, paae 110 of Deeds. uHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the Lity of Anaheim on February 13, 1?18, at i:3o p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code. Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recomme~dations in connec[ion therewith; and WfiEREAS, said Commission, af[er due inspectton, investigation and study made by itself and in tts behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject prnperty from the RS-7200 (Residential, Single-Family) Zone to the CO (Carmercial, Offlce and Professional) Zone. 2. That although the Anaheim General Plan designates subject property for low density residential land uses, adjacent p:operty to the west and nearby properties to the north and south are designated for general conmercial land uses. 3, That the oroposed reclassification is hereby granted on the basis that the r+esterly portion of the proposed devetopment was previovsly approved for commercial and professional development in connection «ith Reclassiftcation No. 67- 66-63 (approved by the City Counctl on January 25, 1956) and subJect to the petitioner~s stipulation that any modifications to the development plans. as presented Lo the Plannin9 Lommission, shall be revlewed and approved by the Planning Commission prior to the issuance of buildin9 permits. 4. That the proposed reclassification of subJect property Is necessary and/or dcsirable for the orderiy and proper development of the community. 5. That the proposed reclassification of suhject property does properly relate to the zones and their permitted uses locally established in close oroximity PC78-25 [o subJect property and to the zones and their permitted usr_s generally established throughout the community. 6, That the proposed reclassificatton of subject property requires the dedication and improvement of abu[ting streets in accordance with the Circulation Element of the General Plan, due to the anticinated increase in traffic a~hich will be generated by the intensification of land use. 7. That 11 persons fndicated their presence at said public hearing in opposition. ENVIROtIMENTAL IMPACT FINDIkf; That the Anaheim City Plannin~ Commfssion has reviewed [he subJect proposal to rrciassify the zoning fron RS-7200 (RESIDENTIAL, SI~~GLE-FAMILY) to CO (COt1MERICAL, OFFICE AND PROFESSIONAL) on a rectanqularty-shaped parcel of land consfsttng of aoproximately O.Q acre, having ipproximate `rontages of i9F, feet on the south side of South Strcet, 200 fect on the east side of Harbor Boulevard and 200 feet on the west side of Hciena Street and does hereby approve the Negative Declaration from the requirement to orepare an environmental impact report on the basis that there rrould be no significant indivtdual or cumulative adverse environmental impact due to thc approval of this Negativc Declaration; that although [he Anahei^~ General Pian designates the subject property for low density resideniial land uses, adjacent property to the wcst and nearby oroperties [o the north and south are designated for general commercial land uses cammensurate with the proposal; that no sensitive environmental impac[s are involved in the proposal; that the Initial Study submitted by the pe[itioner indica[es no signific~n[ individual or cunulative adverse r.nvironmen[al impacCS; and that the Negative Declara[ion substantiating the forcgoing findings is on filc in thc Cit/ of P.nahcir~ Planninq Departr~en[. NO'a, THEREFORE, BE IT RFSOL~'ED tha[ the Anaheim City r'lanning Commission does hereby grant subject Petition for Reclassif(cation and, by so doinq, that Title 18-Zoning of ihe Anaheim Municipa) Code be anended to exclude the above-described property fron thc RS-72~0 (P,ESIDE~ITIAL, SINGLF-FAMILY) 20t~F and tn incorporate said describcd oroper*.y into [he CO (COM'~ERLIl1L, OFFICE At~~ PROFESSIONAL) ZONE upon the follo~•+ing conditions which are hereby found to be a nec~ssary prerequistte to the proposed use of subject proacrtv in order to preserve [he safety and general welfare of thc Ci[Izens of the City of Anaheim: 1. Th~t the owner(s) of suhject pronerty shall deed to the City of Anahelm a strip of land 25 feet in widch from the centerlinc of the strePt along Ffelena Street for street widening ourposes. 2. ThaL all engTneering requtrements of ihe Lity of Anaheim along South Street, Helena Street, and Narbor Boulevard, including preparation of improvement plans and installation of all improvements such as curbs and gucters, sidewalks, stree[ grading and paving, drainage facilicies o~ other appurtenant work, shail be complied with as required by the City Engineer and in accordance with standard plans and specifications on file fn the office of the City Engineer; that street ltght facilities along South Street. Helena Street, and Harbor Boulevard shall be installed prior to final building and zoning inspections unless otherwise approved by the Dtrector of Public Utilities; or that a bond, certificate of deposit, letter of credit. or cash, in an amount and form satisfactory to [he City of Anahcim, shall be posted with the Ciey to guarantee thc installation of the above-mentioned requirements prior to fir,al occupancy. 3. That the owner(s) of subJect property shall pay to the City of Anaheim the sum of sixty ce~ts (60 E) per front foot along South Street and Flelena Street for cree planting purposes. That fire hydrants shail be installed and charged, as requtred and determined to be necessary by the Chief oY thc Fire Department, prior to commencement of structural framing. 6. That subject prooerty shall be served by underground utilitles. 7. That drainage of subJect property shall be dispose~l of in a manner satisfactory to the Li[y Engineer, 8. Prior to the tniroduction of an ordinance rezoning subject property, Condition Nos. 1, 2 and 3, above mentioned, shall be completcd. The provisions or rights granted by this resolution shall become null and void by action of Yhe Pianning Commission unless said condittons are complied with within one year from the date hereoF, or such further time as the Planning Comnission may grant. ?. That Co~di[ion Nos. 4, 6 and 7, above mentioned. shall be complied with prior to final building and zoning inspections. 10. That the subject property shall be developed substantialiy in accordance rri[h plans and specifications on file wi[h the Lity of Anaheim, marked Exhibits 1, 2, and 3. and that any modifications thereto shail be sukxnitted to the Planning Commission for revieo~ and approval prior [o the issuance of building permits.
