PC78-254 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PET1710N FOR CONDITIONAL USE PERMIT N0. 1905 BE GRANTED 1~M EREAS, the Anahelm City Planning Commission did recelve a verifted Petition for Conditional Use Permit from ROBBIE KAUFMAN AN~ JAMES NORMAN MORGAN, 300 South Harbor Boulevard, Sulte 510, Anahelm, California 91805, owners of certain real propercy situated in the City of Anahetm, County of Orange, State of California, described as: Beginning at the Northwesterly corner of Block 8 of a replay of the Orchard Park Tract, as snown on a Map recorded in Book 7~ page 6 of Mlsceilaneous Maps, records of Orange County, Californla; thence Eesterly along the Northerly line of said Block, 249.75 feet; thence Southerly parallel to the Westerly line of said Block 8, 229.5 feet; thence Westerly parallel with the Northerly line o,` said Block, 249.75 feet to the Westerly line of said Biock; thence Northerly along the 4lesterly line of said Block 8, 229.5 feet to [he place of beginning. Excepting therefrom the Northerly 30 feet of said land as conveyed to the City of Anaheim~ a Municipal corporatlon~ for road and incidental purposes, by an instrument dated October 11, 1912 and recorded December 9, 1912 in Book 224, page 110 of Deeds. ~lHEREAS, the Lity Planntng Cortmission dld hold a public hearing at the City Hall tn the City of Anaheim on November 6, 1978~ at 1:30 p.m., notice of sald pubilc hearing havtng been duly given as required by law and fn accordance with the provtsions of the Anaheim Munlcipal Code, Chapter 18.03. to hear and consider evldence for and against safd proposed conditional use and to tnvestigate and make findings and recommendatlons in connection therewith; and WHEREAS, said Commission~ after due inspectton, i~vest(gation and study made by itself and In its behalf~ and after due considerat(on of all evidence and reRorts offered at said hearing, does find and determine the foliowing facts: l. That the proposed use (s properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18,03.030.010 to wit: to permtt an automobile parking lot in the RS-7200 (Resldential. That the proposed use is hereby granted on the basts that the use ts the highest and best use o` the property and provides maximum protectton to the adJacent residential areas in that onty a parking tot as shown on the approved exhibits may be built; and subject to the following s[ipulations by the pet(tloner: a. That the use wfll be solely for the tenanCS in the adJacent building on Harbor Boulevard (typically conslsting of architectural, legal a~d engineering professions with no doctors' offices or other medically- related uses). b, That the trash enclosures shali be relocated a minimum of 10-feet from the adJacent residential zoning to the sou[h, subJect to the Lity Sanitation Division's approval. c, That the landscaped setback between Helena Street and the 6-foot hlgh block wall shaiibe he~vtly landscaped to effectively vlsually buffer the use from the nearby resideniial uses. 3. That thc proposed use ts hereby granted subJect to [he driveway on South Street providing botfi ingress and egress to the property. 4. That the above-mentioned waiver (a) is hereby granted on the basts that the proposed 6-foot high block wall will provide an ~ffective buffer [o protect and maintatn the integrity of the nearby residential uses tn the RS-7200 zone. 5. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 7. That the size and shape of thc site proposed for the use is adequate to allow the fuli developRent of the proposed use in a manner not detrtmental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the Llty of Anaheim, 8. EtIVIRONMENTAL IMPACT fl1~DING: That thc Anaheim City Planning Commission has reviewed the proposal to cons[ruct an office building with waivers of mintmum number of parkin9 spaces, minimum site area, maximum structural height and required site screening adJacent to a residentially zoned parcel on a rectangularl~~-shaped parcel of land consistfng of approximately 0.4 acre located at the southeast corner of South Street and Harbor Boulevard, having approximate frontages of 93 feet on the south side of South Street and 200 feet on the eas[ side of Harbor Boulevard; and also to permit an automobile park(ng lot wi[h waivers of permi[ted encroachment of a 6-foot high wall and parking spaces in the front se[back on a rectangularty shaped parcel of land conststing of approximately 0.5 acre located a[ the southwest corner of South Street and Helena Street, having approximate frontages of 103 feet on the south slde of South Street and 200 feet on [he west side of Helena Street; and does hereby approve the Negative Declaration from Che requirement to prepare an environmental impact report on the basis that there would be no significanc individual or cumulative adverse environmental impact due to the approval of this Negatlve Declaration since the Anaheim Generai Plan designates ihe subJect property for commercial-professlonal and lorr-densfty reside~tlat land uses commensurate with the proposal; that no sensi[ive environmental impacts are involved in the proposal; tha[ [he initlal Study submitted by the petf[toner indlcates no signiffcan[ tndlvidual or cumulative adverse environmental impacts; and that the Negative Geclaration substantiattng the fore9oing findings is on file in the Lity of Anaheim Planning Department. NOW, THEREFORE, 8E IT RESOLVED that thc Anaheim City Planning Cortmission does hereby grant subJeci Petition for Conditional Use Permit, upon the following conditlons which are hereby found to be a necessary prerequtslte to the proposed use of the subJect properiy in ordcr to preserve thc sifety and general welfare of the Citizens of the City of Anaheim: 1. That [he owner(s) of subject property shall deed to the City of Anahetm ~ strfp of land 32 feet In width from the centerline of the street along South Street, and a strip of land 25 feet in width from the centerline af the street along Helena Street for stree[ wtdentng purposes. 2, That all engineering requirements of the City of Anaheim along South Street includin9 preparatlon of tmprovement plans and tnstallatlon of all improvements such as curbs and gu[ters. s(dewalks, street gradfng and paving. drainage facilitles or o[her appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the Lity Engineer; that street lighting facilitles along South and Helena Streets shall be installed prior to final bullding and zoning inspecttons unless othe n+ise approved by the Director of Publtc Utilltles, and in accordance with standard specifications on flle in the Office of the Director af Public Utillties; or that a bond, certlfica[e of deposlt, letter of credit, or cash, in an amount and form -3_ Pc7~-254 satisfactory to the City of Anaheim shall be posted wlth the Ci[y to guarantec that the above improvements will be installed prior to occupancy. 3, That the owner(s) of subject proper[y shall pay to the City of Anaheim the sum of three and one-half dollars (53.50) per front foot along Harbor Boulevard for street lfghting purposes. y, That sTdewalks shall be installed along Helena Street as requlred by the City Engineer and in accordance wlth standard plans and specifications on file in the Office of the City Engineer. 5, Tha[ the owner(s) of subJect property shall pay to the City of Anaheim the sum of ninety-five (95L) cents per front foot along South and Helena S[reei for tree pianting purpases. 6. That trash stora9e areas shall be prowided in accordance Hith approved plans on file a~ith the Office of the Direc[or of Public Works. 7, That fire hydrants shall be instalied and charged as requlred and determined Lo be necessary by the Chief of the Fire Depa~tment prior to commencement of structural framing. 8. Tha[ subjec[ proper[y shall be served by underground utllities. 9, That drainage of subJect property shali be disposed af Tn a manner satisfactory to the City Englneer. 10. That su6ject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhiblt Nos. 1 through 3: provided, however~ that Che trash enclosure shall be relocated a minTmum of 10 feet away f~om the RS-7200 zoned parcel to the south. 11. That Conditton Nos. 1, 2. 3 and 5, above-mentioned, shall be canplied wich prior to the cortenencement of the activity authorized under [his resolution. or prior to the time that the butlding permit is issued, or wlthin a period of one year from date hereof, whtchever occurs first, or suc~ further [ime as the Planning Commisslon may 9ra~t. 12, That Condition Nos. 4, 6. 8, 9 and 10, above-mentioned, shall be complled wtth prior to final building and zo~ing inspec2ions. BE IT FURTHER RESOLVED that the Anaheim City Planning Cortmissio~ does hereby flnd and determine that adoption of thfs Resolution ts expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth.
