PC78-257 A RESOLUTION OF THE APlANEIM CITY PLANNING COMr115510t~ THAT PETITION FOR CONDiTIONAL USE PERMIT ND, 1904 BE DENIED WHEREAS, the Anahcim City Planning Comnission did receive a verifled Pe[itlon for Condi[ional Use Permit from WILLIAM H. AND JOAN E. SHOEMAKE, 224 East Broadway, Anahetm, California, 92805, owners, and CLARE~JE BALLAFtD, 9~0 Peary Way. Anaheim, Cal~~ornia 92807, agent, af certain real property situated in the City of Anaheim, County of Orange, State of California, described as: The East 1/2 of LoC 6 and atl of Lot 7 in Block M of "Lenter Tract, Anaheim", in the City of Anahelm, as per map recorded in book 14, pa9e 13, Miscellanecus Records, Los Angeles County, California. WNEREAS, the City Planning Coc+mission dld hold a puhlic hearing a[ the City Hall in the City of Anaheim on t~ovember 6, 1~78, at 1:30 p,m., notice of said public hearing having been duly given as required by law and 1n accordance with the provisions of the Anaheim Municipal Code, Chapter 18.rJ3, to hear and consider evidence for and against said proposed conditional use and to tnves[(gate and make findings and recommendations in connection therewith; and WHEREAS. said Commission, af[er due inspection, inves[igation and study made by itself and in its behalf, anJ after due consideration of atl evidence and reports offered at said heari~g, does find and determine the following facts: 1. Tha[ the proposed use is properly one for whic'~ a ccnditional use permlt is authorized by Anaheim Municipal Code Sectton 18.44.05~.~~0 to wit: to permit a church with waivers of: (a) SECTION 18,06.Cb0.02G5 - Minfmum number of arkina s aces. 12 required; proposed (b) SECTION 13.k4.063.020 - Minlmum structural setback. 5 eet required; none ex sting) 2. That the proposed use and aforementioned waivers are hereby denied on the basis that the subJect proper[y is currently developed in a manner which would be substandard for a church in that there vrould be inadequate parking areas and that other nearby parceis wo~ld be detrimentally effected by the resulting off-site parking if the church were approved. 3, That the proposed use will adversely affect the adJoining land uses and the growth and development of the area in which tt is proposed to be located. 4. That the size and shape of the s(te proposed for thP use is not adequate to allow the full development of the proposed use i~ a manner not detrimental to the particular are~ nor to the peace, health, safety, and general welfare of the Clttzens of the City of Anah~im. EtJVIRONNENT/1L IMPACT FIHDING: That the Anaheim Lity Plannfng Corru~isslon has reviewed the proposal to permiL a church wiih waivers of mintmum number of parking spaces and minlmum structural setbacE; on a rectangularly-shaped parcel of land consisttng of approxtmately 0.2 acre located at the southv,est corner of Broadway and Philadelphta Street, having approximate fronta9es of 6~ fcet on the south slde o' Broadway and 134 feet on the west side of Philadelphia Strect; and does hereby aPprove the Negative Declaration from the requirenent [c prepare an envlronmental impact report on the basis that there would be no signtficant individual or cumulative adverse environmental impact due to the approval of this *legative Declaration since the Anaheim Gencral Pla~ designates the subJect property for medium density residential land uses conmensurate with the proposal; tha[ no sensitive environmental impacts are involved in the proposal; that the Initial Study su'xnitted by the petitioner indlcates no signlficant individual or cumulative adverse environmental impacts; and that the Negative Declaratfon substantiating [he foregoing findings is on file in [he City of Anaheim Planning Department. NOW, TIiEREFORE, BE IT RESOLVED that the Anaheim City Planning Canmission does hcreby deny subject Petition for Conditional Use Permit on thc basis of the aforementloned findings.
