A RESOLUTION OF THE AtlAHEIM CITY PIANNiNG COH!iIS510t1
THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1910 BE GRANTED
WHEREAS, the Rnaheim City Planning Commission did receive a verified
Petition for Conditional Use Permtt from LEW L. BOIJERS. 17300 Corktll Road~ pesert
Hot Springs, California, 92249, owner, and ROBERT P, HAP,DING, 1733 West La Palma
Avenue. Anaheim, California 92301, agent, of certain real property situated in the
City of Anahein, County of Orange, State of Calffornia, described as:
Lot 9, of Trace No. ~+83 as shown on a map thereof recorded in the
records of Orange Lounty, California.
WHEP,EAS, [he Ci[y Planning Cor.mission did hold a public hearing at the City
Hall tn the Ctty of Anahelm on Navember 6, 1978, at 1:30 p.m., notice of sald pubiTc
hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Municfpal Code, Chapter 18,03, to hear and constder
evidence for and againsc safd proposed condi[tona) use and to investigate and make
flndinys and recorrmenda[ions In connection there,rith; and
LlHEREAS, said Cormisston, aF[er due Inspection, Investigation and sCudy made
by iLSelf and (n i[s behalf, and after due consideration of all evidence and reports
offered at said hearing, does find and determine the following facts:
1. That the proposed use fs properly one for which a conditional use
permit is authorized by Anaheim Municipal Code Section 18.44.050.040 to wit: to
permit a therapy and massage faciiity.
2, That rhe proposed use 15 hereby granied to permit !apartese physlo-
therapy (Shlatsu).
3. That the petitioner stipulated that the hours of operatlon shall
typically be:
10:00 a.m. to 6:00 p.m. - ftonday through Friday
10:00 a.m, to 3:00 p.m. - Satu~day
Closed - Sun~ay
4. That the proposed use wfll not adversely affect [he adjointng land uses
and the growth and development of the area Tn which it Is praposed to be located.
5. i'hat the sizc and shape of the stte proposed for the use is adequate to
allow the full developmcnt oP the proposad use ln a manner not detrimental to ths
particular area nor to the peace, health, safety~ and generai weifare of the Citizens
of thc City of Anaheim.

6. That the granting of the Conditiortal Use Permit under the conditions
imposed, if any, wtll not be detrimental to the peace, heaith, safety and general
welfar~ of the Citlzens of the Clty of Anaheim.

opposition; and one person indicated her presence in support of s~bJect request. and
that no correspondence was recetved in oppositlon to the subJect petttlon.
ENVIRONMENTAL IHPACT FINDIt~G: The Planning Director or hts authortzed
representatfve has determined that the proposed project falls withln the deftnitlon
of Cateyorfcal Exemptions, Class 1, as defined in Paragraph 2 of the Ltty of Anaheim
Environmental Impact Report Guidelines and is, therefore, cate9orically er.empt fran
the requirement to prepare an EIR.
NOW, THEREFORE, BE IT RESOLVED that tha Anaheim City Planninq Commission
does hereby grant s~bJect Petttion for Conditional Use Permit, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed use
of the subJect property in order to preserve [he safety and general welfare of the
Citizens of the City of Anaheim:
1. That the owner(s) of subject property shall pay to the Ci[y of Anaheim
the sum of three and one-halr' dollars (53.50) per fronc foot along La Paima Rvenue
(Lot 9, Tract 483) for street iighting purposes.
2. That subject property shall be developed substantlally in accordance
with plans and specifications on file with the City of Anaheim marked Exhlbi[ No. 1.
3. That the hours of operation shall typically be:
10:00 a.m, to 6:00 p.m. - Monday through Friday
10:00 a.m, to 3:00 p.m. - Saturday
Closed - Sunday
BE IT FURTIIER RESOLVED tha[ the Anaheim City Planning Canmission does hereby
find and determine [hat adoptton af this Resolution is expressly predicated upon
applicant's compliance with each and all of [he conditions hereinabove set forth.
Should any such condition, or any part thereof, be declared invaltd or unenforceable
by the flnal Judgment of any court of compe[ent Jurtsdiction, then this Resolutlon,
and any approvals herein contained, shall be deemed null and void.
