RECOMIIENDING TO THE CITY COUNCIL THAT THE REQUEST TO AMEND
CONDITIONS OF APPROVAL OF RESOLUTION N0, 6?6~ AND
ORDI~IANCE N0. 1619, ADOPTED IN LONNECTfON W17H
RECLASSIFICATl0~1 N0. 60-61-9Fi BE APPROVED
WHEP,EAS, the petitioner submit~ed a request for an amendment to the
conditions of approval contained In Resolution No. 6960 and Ordinance No. ~6t9
adopted in connecti~n with Reclassification No. 60-61-98 on property consisting of
approximately 2.4 acres located south and west of the southwest corner of Vermont
Avenue and Anaheim Boulevard. having approximate frontages of 230 feet on the
southside of Vermont Avenue and 223 feet on 2he west side of Anaheim Boulevard~ and
being located approximately 153 feet south of the r_enterline of `lermont Avenue and
170 feet west of the centerline of Anaheim Boulevard; and
WHEREAS, the petitioner reque~ts deletion of the following conditton
contained in the above-referred to resolution and ordinance of the City Council:
"That thc cr.tsting P-L (Parktng-Landscaping) Zonc, along Los
Angeles Street between Vermont Avenue and Ball Road shall be
maintained with the excepilon that the required landscaping from
the sou[herly boundary of Tamasha Glub parking lot, including the
Tamasha Club, extending northerly to Vcrmont Ave~ue, shall be
reduced to a 6-foo[ wide strip abu[ting the planned highway right-
of-way line of subject properttes; that the GO-foot building
se[back Ilne shall be maintafned, and that street trees shall be
provided approximately every 40 feeL adJacent to the planned
htghway right-of-way line.", and
WIiEREAS, the Anaheim City Planning Cortimission did hold a public hearing at
the Lity Hall in the City of A~aheim on November 20, 1978, at 1:3~ p.m., nottce of
said public hearing having been duly yiven as required by law and in accordance with
[he provisions of the Anaheim Municipal Code, to hear and consider evidence for and
against said proposal to amend the conditions of approval of Reclassification No. 60-
61-98~ and to investigate and make findings and recomnendations in connection
therewith; and
b1H[REAS, said Commisslon, af[er due inspection, tnvesttgation and study made
by itself and in Its behalf, and after due consideration of all evidence and reports
offered at said hearing, DOES HEREBY FIMD:
i. That no one indfcated their presence at said public hearing tn
opposition; and that no correspondence was received in oppositton to subject
peti tior~.
2. That the proposal is necessary and/or desirable for the orderly and
proper development of [he cortr,wnity.

3. That the proposal does properly relate [o the zones and their permttted
uses locally established in close proximity [o subJect property and to the zones and
their permitted uses generally established throu9hout thc community.
E~IVIRONME~~7AL IMPACT FINDING: That the Anaheim City Planning Comnission has
revlewed the proposai ta permit a board and care facility for the elderly and to
amend Yhe conditions of approval in connec[ion with reclassification of property
consisting of approximately 2,4 acres loca[ed south and west of the southwest corner
of Vermont Avenue and Anaheim Boulevard, having approximate frontages of 230 feet on
the south side of Vermont Avenue ar.d 223 feet on the tiaest side of Anaheim Boulevard~
and being located approximately 153 feet south of the centerline of Vermont Avenue
and 170 feet west of the centerline of Anaheim Boulevard; and does hereby approve the
Negattve Declaration from the requirement to prepare an environmental impact report
on the basis that there would be no significant individual or cumulative adverse
environmental impact due to the approval of this Hegative Declara[ion since the
Anaheim General Plan desfgnates the subject property for general cornmerclal land uses
conmensurate rrith the proposal; [hat no sensiiive environmental impacts are involved
in the proposal; that the Initial Study submitted by the petitioner irtdicates no
significan[ individuai or cumulitive adverse environmental inpacts; and that the
Negative Declara[Ion substantfating [he foregaing findin9s is on file in the City of
Anaheim Planning Departmenc.
NOW, THERFFO?E, BE IT RESOLVED [hat chc Anahein City Plannin9 Commtssion
does hereby recommend to the City Council of the City of Anaheim that the request to
delete the subject condition oE approval of Reclassification ~~o. 60-G1-93 be approved
on the basis of and subjcet to [he foregoing findin9s and recommendations, and upon
following conditions which are hereby found to be a necessary prerequisi[e to the
proposed use of the subject property in order ;o preserve [he safe[y and generat
welfare of the Citizens of thc City of Anaheim:
1. That all enyineertn9 requirements of the City of Anaheim along Vermont
Street including preparation of improvernent plans and tnstalla[ion of all
fmprovements such as curbs and gutters, sidewalks, street grading and pavtng,
drainage facilitics or otncr appurtenant v+ork, shaii be conolied wtth as reQUired by
the City Engineer and in accordance with standard plans and specifications on file in
the Office of the City ERgineer; that street lighting faclli[les along Anaheim
Boulevard and Vermont Strce[ shall be (ns[alled prior t~ final buildtng and zoning
inspections unless otherwise approved by the Director of Public Utflities, and (n
accordance wlth standard speciflcations on file in the Office of the Director of
Public Utflities; or that a bond, cer[tficate of deposit, letter or credtt, or cash,
in an amount and form satisfactory [o the City of Anaheim shall be posted with the
City to guarantee [ha the ibove tmprov~ments are installed prior to occupancy.
2. That the a.vner(s) of subject property shall o~y to the City of Anaheim
the sum of three and one-half dollars (S3.50) per front foot along Vermont Street for
street lighting purposes.
3. Tha[ the owncr(s) of subJect property shall pay to the City of Anaheim
the sum of ninecy-five (95L) cents per front foot alon9 Anaheim Boulevard and
Vern~n[ Street for tree planting purposes.

4. That sidewalks shall be installed along Anahcim Boulevard as requfred
by the City Englneer and in accordance with standard plans and specifications on file
in the Office of the City Engineer.
5, That trash storage areas shall be provided in accordance with approved
plans o~ file wlth the Office of the Director of Pubilc Works.
6, That fire hydrants shall be installed and charged as required and
determined to be necessary by the Lhief of the Fire Department prlor to comme~ceme~t
of structural framing.
7, That drainage of subject property shall be disposed of in a manner
satisfactory [o the Ci[y Engtneer.
$, That Condition Nos. 1, 2 and 3, above-mentioned. shall be canptied wTth
prior to the time that a 6uilding permit Is issued, or within a period of one year
from the dace hereof, or such further time as the City Council may grant.
g, That Condition Nos. 4, 5 and 7, above-mentioned, shall be complied with
prior to final buiiding and zoning inspections.
BE IT FURTHER RESOLVED that the Anaheim Lity Plannin9 Comnission does hereby
find and determine that adoption of chis Resolution is expressly predicated upon
applicant's compliance with each and all of the conditions hereina6ove set forth.
Should a~y such condition, or any part thereof, be decl~red invalid or unenforceable
by the ftnai judgment of any court of competent jurisdic[ton, then this Resolution,
and any approvals herein co~tained, shall be deemed null and void.
