WHEREAS, said Commission, after due inspectton, investi9atlon and study made
by itself and in its behadoesafindfa~d determinedihetfollowing,factsence and repor[s

~, That the petitioner proposes reclassificatlon of subject property from
the County of Orange A-1 (General, Agricultural) Diftrict to the City of Anahetm RS-
5000 (Residential, Single-Family) Zone.
Z, That the Anaheic~ General P',n designates subJect property for low-
medium density residential land uses.

and/or desirable for the orderiy and proper develoPmen[ of the community.
4. That the proposed reclassification of subject property does properly

EIlVIROtlMENTAL IMPALT ~!~~DING: Thac the Anaheim City Planning Conxnission has
reviewed the proposal to reclassify the zoning from County A-1 (General,
Agricul[ural) to Gity RS-5000 (Residential, Single-Famtly) zone on an irregularly-
shaped parcei of land consisting of approximately 0.7 acre, having a frontage of
approximatelY 223 feet on the West side of Bubach Sireet, havin9 a maximum depth oF
approximately 70 feet, a~d being located approximateiy 560 feet norLh of Lhe
centerline of Orangethor~e Avenue; an~ does herehy approve the Negative Declaration
from the requirement to prepare an environmental impact report on the basis that
there would be no significant tndividual or cumulative adverse environmental i~pact
due to the approval of this Negative Declaration since the Anr~heim Generat Plan
designates Che subJect property for low-medlum density residential land uses
commensurate with the proposal; that no sensittve environmental 'smpacts are involved
in the proposal; that the Initiai Study submitted 6y the petltioner ind(cates no
significant individual or cumulative adverse envTronmental impacts; and that the
Negative Declaration substantiating the foregoing findings is on file in the Ctty of
Anaheim Planning Department.
NOW, TNEREFORE, BE IT RESOLVED that the Anahelm City Planntng Carniission
does hereby grant subJect Petltion for Reclassificatton and, by so doing, that Title
18-Zoning of the Anahelm Municipal Code be ame~ded to exclude the above-described
property from the LOUintoA theCERS-~5000 G(RESIDENTIAL?oNSINGLE-FAHILY)c~ZONEauponsthe

followTng conditions which are hereby found to be a necessary prerequisite to the
proposed use of subJect property in order to preserve the safety and general welfare
of the Citizens of the City of Anaheim:
~, That street lighting facilities along Bubach Street shall be installed
prior to finat building and zontng inspections unless otherwise approved by thie
Director of Pubiic Utilities, and in accordance with standard specifica[lons on file
In the Office of the Director of Public Utilities; or that a bond, certificate of
deposit. letter of credtt, or cash, in an amount and form satisfactory to the City of
Anaheim shall be posted with the City to guarantee that the above improvements will
be installed prior to occupancy.
Z, That sidewalks shall be installed along Bubach Street as required by
the~ Clty Engineer and in accordance with standard plans and specificat.ions on file tn
the Office of [he City Engineer.
3, That fire hydrants shall be ins[ailed and charged as required and
determined to be necessary by the Chief of the Fire Department prior Co commencement
of structural framing.
4, That the developer shall acqutre access rights across the one-foot
holding strip on the west side of Bubach Street.
5, That the vehicular access ri9hts to Lakevtew Avenue shall be dedicated
to the City of Anaheim.
6, That these reclassification proceedings are granted subject to
completion of annexation of subject property Co the City of Anaheim.
~, That the owner(s) of subJect property shall pay appropriate drainage
assessment fees to the City of Anahelm as dete~mined by the City Engi~eer prlor to
issuarsce of a buiiding permii,
$, That the owner(s) of subject property shall pay the traffic signal
assessment fee (Council Poticy No, 214) amountl~9 to $36.00 per each new dwelling
unTt prlor to the issuance of a building permit.
y, Prior to the introductlon of an ordinance rezoning subJect property~
Condition Nos. 1. 4, 5 a~d 6, above-mentioned, shall be completed. The provlslons or
rights granted by this resolution shalt becomc null and vold by action of the
Planntng Commission unless sald condittons are complied with withTn one year from the
date hereof, or such further time as the Planning GommTssTon may grant.
~p, That ConditTon No. 2, above-menttoned, shall be comPlied with prior to
final butiding and zonin9 inspections.
BE IT FURTHER RESOLVED that the Anaheim Clty Planning Commissio~ does hereby
find and determine that adoption of thls Resolutlon is expressly predicated upon
applicant's compliance with each and all of the conditions herelnabove set forth.
Should any such conditlon, or any part thereof, be decla~ed lnvalid or unenforceable

bY the final Judgment of any court of competent Jurisdiction, then this Resolutton~
and any approvals herein contained, shall be deemed null and void.
