PC78-266 A RESOLUTION OF THE APJAHEIM CITY PLANNING COHMISSION THAT PETITION FOR CONDITIONAL USE PERMIT W0. 1906 BE GRANTED WHEREAS, the Anaheim Ctty Ptanning Commission did receive a verified Petltion for Condi[ional Use Permit from fOREST LAWN tEMETERY ASSOCIATION, P. 0. Box 1151, Glendale, Caltfornia g1209, oorr~er, and JO;iN HELt11CK AND THOMAS SEBOURN, 1225 North Euclid Street, Anahelm, Catifornia 92801, agents, of certain real property situated in the City of Anahetm, Coun[y of Orange, State of Califorria, described as: Parcel 49 of a Parcel Map recorded In Book F9, Pages 2 and 3, Orange County, California. WHEREAS, the City Planning Commission did hold a public hearing at the City Nail i~ the Ci[y of Anaheim on November 20, 1978, at 1:30 p.m „ notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anahein Municipal Lode, Chapter 18.03. to hear and consider evidence for and against said proposed conditlonal use and to investigate and make findings and recommendatlons in co~neciton therewith; and WFIEREAS, said Commission, after due inspection, investigati~n and siudy made by itself and in its behalf, and after due conslderatton of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Sectlon 18.44.05~•010 to wit: To permit on-sale beer and wine in an existing restaurant. 2. That the proposed use wil) not adversely affecf the adJofning land uses and the grcwth and development of the area tn which it is proposed to be located. 3. That the eize and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to [he peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 4. That the granting of the Canditlonat Use Permit under the condltions imposed~ if any, wiil not be detrimentai to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 5. That no one Indicated their presence at said public heartng Tn oppositfon; and that no corresponde~ce ares received in opposition to the subJect petition. ENVIRONMENTAL IMPACT FINDING: The Planning Dlrector or his authorized representative has determined that the proposed project falls withir. the definitfon of Categorical Exemptions, Class 1, as defined in Paragraph 2 of the City of Anahetm PC78-266 .. ~ ~ Env(ronmental Impact Report Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant s:~bject Petition for Conditional Use Permit, upon the following condttions which ara hereby found to be a necessary prerequisite to the proposed use of the subJect property tn order to preserve the safety and ge~eral welfare of tne Cltlzens of the City of Anaheim: 1. That subject property shall be devetoped substantialty tn accordance with plans and specifications on arith wlth the City of Anahelm marked Exhibit Nos. 1 and 2. BE IT FUftTHER RESOLVED that the Anahe(m City Planning Commission does hereby Find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and ali of the conditions herelnabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final Judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
