PC78-269 A RESOLUTION OF TIiE ANAH[IM CITY PLANNING COHF115510N THAT PETITIOtJ FOR CONDITIONAL USE PERFIIT N0. 1908 BE GRANTED WHEREAS~ the Anaheim City Planning Commission did receive a verifled Petition for Conditional Use Permit from GOLDEN WEST EQUITY PROPERTIES, INL.~ 3931 Mac Arthur Boulevard, Newport Beach, Caltfornia 92660, oHmer af certain real property situated in the City of Anaheim~ County of Orange, State of California, descrlbed as: That portion of [he Northeast quarCer of Sectton 26, Township 4 South, Range 10 West in the Rancho San Juan CaJon de Santa Ana, as shown on a map recorded ;n bool; 51, page 10 af Miscellaneous Maps, records of Orange County, Californta, described as follows: Parcel 4, as shown on a Map recorded in boQk 81, Page 32 of Parcel Maps, in the office of the County Recorder of said Orange County. WHEREAS, the Ltty Planning Commission did hold a public hearing at ihe City Hall in the City of Anaheim on 4ovember 20, 1978, at 1:30 p,m., notice of said public hearfng having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against safd proposed condiLtonal use and to inves~igate and make findings and recommendations in connectton therewith; and WHEREAS, said Comr.ission, af[er due inspection, investigation and study made by itself ar.d in its behalf, and af[er due consideration ofi all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one Eor which a conditional use permit is authorized by Anahefm Municipal Code Section 18.61.050.39n to wit: to permit on-sale alcoholic beverages in a resiaurant and banquet facility. 2. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is adequa[e [o ailow the full development of the proposed use in a manner not detrimental to [he particular area nor to the peace, heal[h, safety, and general welfare of the Cttizens of the City of Anahetm. 4. That the granting of the Conditional Use Permit under the conditlo~s imposed, if any, will not be detrtmental to the peace, health, safe[y and general welfare of the C!tizens of the City of Anaheim. 5. That no one indicated their presence at said publtc heartng In opposition; and tha[ no correspond~nce was recelved in opposition to [he subJect petition. p~78-268 EP~VIRONMENTAL IMPACT FINDING: The Plannin9 Director or his authorized representative has detcrmined that the proposed proJect falis within [he definitlon of Categorical Exemptions, Class 1, as defined in Paragraph 2 of the City of Anahelm Environmental Impact Report Guldeiines and is, therefore, categorically exempt from the requirement to prepare an EIR. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby gran[ subject Petitfon for Conditlonal Use Permit, upon the foilowing condltians which are hereby found to be a necessary prerequlsite to the proposed use of the subject propcrty in ordcr to preserve the safety and gencral weifare of the Citizens of [he City of Anaheim: 1. 7hat the o.~mer(s) of subJect property shali pay the traffic si9nal assessment fee difference between industrlal and commercial use at $1y0.00 per 1000 square feet of building or fraction thereof for the entire restauran[ and fanquet facility. 2. 7hat subJect property shali be developed substanttally in accordance witfi plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. 3. That Condi[ion No. 1, above-meniioned, shall be compl(ed with prtor to the commencement of the acttvlty authorized under th(s resolutfon, or prior to the tlme th~t [he building pcrmit is lssucd, or rrichtn a period of one year from datc hereof, whichever occurs first. or such further ttme as the Planning Lommisston may grant. ~r, That Londttion No. 2, above-mentioned~ shall be complled with prior to finat building and zoning inspections. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby flnd and determine that adoption of this Resolution ls expressiy predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. ShovEd any such condltion~ or any pari thereof, be declared invatld or unenforeeablc by the final judgment of any court of competent Jurlsdiceion, then this Resolutlon~ and any approvals hereln contalned, shall be deemed null and void.
