WHEREAS, the Anaheim City Planning Ccmmission did receive a verified
petition for Reclassificatian frum ELIZA°ETH LA~ILASTER, Cherokee Mobile Garden, 235
South Beach Boulevard, Anaheim, California g28Q4, owner, and AL~ERT H. PADILLA, 11563
l.indale Street, Norwalk, Laltfornia ?065C, agent, of certain real property situatEd
in the City of Anaheim, Coun[y of Orange, State of California, described as follows:
That portion of the North half of the Southeast quarter of the
IJortheast Quarter of Section 14, Township 4 South, Range 11 West,
S.B.E~. E M., in the Rancho Los Coyotes, City of A~aheim, as shown
on a Map recorded in Book 51. Page 11, of Miscellaneous Maps.
records of Orange Cou~ty, California, lying Southeasterly of the
Southeas[erly line of tha[ certain strtp of land 73•00 feet in
width, described in deed to Orange County Flood Control District
recorded May 25, iQ60, in Book 5258, Page 5F0, of Official
Records. EXCEPT THEREFROM the East 40.00 feet.
WHEREAS, the Lity Planning Canmission did hold a public hearing at the City
Hait in [he City of Anaheim on February 13, 197~, at 1:3~ P•~•. no[ice of said public
hearinq h~ving been duly given as required by law and in accordance wi[h the
provisions of the Anaheim Municipal Codc, Ch~ptcr 18.03. to hear and consider
evidence for and against said proposed reclassification and io inves[igate and ~ake
findinqs and recommendations in c~nnection therewith; and
WHEREAS, said Commission, aE[er due inspection, investigation and study made
by itself and in its behaif, and after due considera[ion of all evidence and reports
offered at said hearing, does ftnd and determine the foilowing facts:
1. That the petitianer proposes reclasslfication of sub.Ject property from
the RS-R-43,000 (Residential~Agricultural) Zone to thc RM-1200 (Residential,
Multiple-Family) Zone.
2. That although the Anaheim General Plan designates subject property for
ca,mercial-professional land uses, the adJacent property to the west and north is
designated for nedium density residential and/or gene~ai comnercial land uses.
3. That the proposed reclassifica[ion is hereby aranted subject to any
modifications to the development plans. as presented to the Plannino Commission,
being reviewed and approved by the Planning Commisslon prior to the issuance of
buildina permlts.
4. That the proposed reclassificatlon of subJect property Is necessary
and/or desirablc for the orderiy and proper development of the community.

5. That the proposed reciassifica[ion of subJect property does properly
relate to the zones and their permit*.ed uses locally established in close proximity
to subJect property and to the zones and their permitted uses generally es*_ablished
throughout the community.
6. That no one indicated their presence at said public hearing in
opposition.
ENVIRONkEtlTAL IMPACT FINDINGS: That the Anahcim City Planning Commission
has reviewed the sutJect proposal to reclassify the zoning from RS-A-43,000
(RESIDENTIAL/AGRICULTUP.AL) to RN-1200 (RESIDENTIAL, MULTIPLE-FAMILY) on an
irregularly-shaped parcel of land consis[ing of approxfmately 1.2 acres, having a
frontage of approximately 255 fee[ on [he west side of Beach Boulevard, having a
maximum depth of approximately 417 feet, and being located approxinately 660 feet
north of the centerline of Orange Avc~ue; and does hereby approve the Plegative
Declaration frcxn [he requirement to prepare an environ~ental impact report on the
basis that there arould be no significant indivtdual or cumulative adverse
environmental impact due to the appraval of this t~e9aCive Declaration; that although
the Anaheim Generai Plan designates [he sub]ect property for commercial-professional
land uses, the adjacent proper[y to the wes[ and nor[h is designated for medium
density resldential and/or general commercial land uses commensurate with the
proposal; that no sensitive environmental impacts are invotved in [he proposal; that
the Ini[ial Study submitted by the petitioner indicates no significant individual or
cumulative adverse r.nvironmental (mpacts; and that [he Negative Dectaration
substantiating the foregoing finfings is on file in the City of Anaheim PlannTng
Departnent.
NOW, THEREFORE, DE IT RESOLVED that the Anaheim Clty Planning Commission
does hereby grant subject Petltion for Reclassification anA, by so doing, thai Title
18-Zoning of the Anaheim Municipal Code be amended to exclude the abnve-described
property from the Rs-n-43,oon (RESIDENTIAL/AGP.ICULTUP.ALj ZONE and to incorporate said
described property into the RM-1200 (RESIDENTIAL, t1ULTIPLE-FAy1LY) ZONE upon the
following conditions which are hereby found to be a necessary prerequisite to *_he
proposed use of subject property in order to preserve the safety and general welfare
of the Citizens of the Ci[y of Anaheim:
1. That all engineering requirements of the City of Anaheim along Beach
Boulevard, inciuding prepara[lon of tmprovement pians and installation of all
improvements such as curbs and gutters, sidewalks, s[reet grading and paving,
draina9e facilities or o[her appurtenant work, shall be complied with as required by
the City Engineer and in accordance with standard plans and specifica[lons an file in
the office of the City Engtneer; that street lightin9 facilities along 9each
Boulevard shall be installed as required by the Director of Public Utilities, and in
accordance with standard specificatlons on file in [he office of the Director of
Public Utilities; or that a bond. certificate of deposit, letter of credit, or cash,
in an amount and form s~tisfactory to the C~ty of Anaheim, shall be posted wfth the
City to guarantee the installation of the above-mentfoned requirements pr?or to final
occupancy.

2, That the owner(s) of suhject property shaii pay to thc City of Anaheim
the sum of sixty cents (60 L) per front foot along Beach Boulevard for r.ree planting
purposes.
3, That trash storage areas shall be provided in accordance with approved
plans on file wtth the Office of the Director of Public Works.
4. That fire hydrants shall be instailed and charged, as required and
determined to be necessary by the Chief of the Fire De~artment, prior to commencement
of structural framing.
5, That subject propcrty shall be served by underground utilities.
6. That drainage of subject property shall be disposed of ir a manner
satisfactory to ihe City Engineer.
7, That the o~•mer(s) of suhjeci oroperty shall pay to the City of Anaheim
[he appropriate park and recreation tn-lieu fees as determined to bc appropriate by
the City Council, said fees to 6e paid at thc time the building permit is issued.
II. That appropriate water assessment fees, as de[ermined by the Directcr
of Public Utilities, shall be paid to the. City of Anaheim prior [o [he issuance oT a
building permit.
9. Prior to the introduction of an ordinance rezoning subject property,
Londition Nos. 1 and 2, above mentioned, shall be ccxnpleted. The provisions or
rights granted by thi, resotution shall becone null and void by action of the
Planning Comnission untass said conditions are complied with o~ithin one year from the
date hereof, or such further [lme as the Planning Commission may grant.
10. That Condi;ton flos. 3. 5 and 5, above menCioneJ, shall be conplied with
prior to final bullding and zoning inspections.
11, That the subject property shall be developed substantially tn
accordance with plans and speciFications on file wtth the City of Anaheim marked
Exhtbi[ Nos. 1 and 2, and that any modificattons thereto shall be sub~Ttted to the
Planning Cormnission for their revTew and approval prior to the issuance of building
permits.
