WHEREAS~ the Clty Planning Commtssion did hold a public hea~ing at the City Hall in the CTty of Anahelm on December 4, 1978, at 1:30 f.m., notTce of said publlc hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Munlcipal Code~ Chapter 1&.03. to hear and consider evidence for and against said proposed varlance and to investtgate and make findings and recomnsendatlons in connection therewith; and PC78-278 WHEREAS, sald GommTsslon. after due inspection, invesiigatlon and study made by itself and in its behatf, and after due consideration of all evldence and reports offered at said hearing, does find arid determine the following facts: 1. That the proposed waivers (a) and (b) are hereby denied on the basts that the petitioner did not demonstrate [hat a hardship exists in that thc size and shape of the subJect property does not differ from other nearby similarly zoned and developed properties; that the property Is no[ be?ng deprived of privileges being enjoyed by other properties in the same zone and vicinity; that the commercial buildings on subJect property benefit from substantTal visibility to nearby arterial highways and a freeway; and that an undesirable precedent wouSd be estabilshed in the Scenic Lorridor Zone Overlay if the.e Wafvers are 9ran[ed. 3. That the Planning Commission hereby determines that the existing ++all sign facing La Palma Avenue canno[ be read from either La Palma Avenue or Imperial ylgho~ay, that said sign is In the category of on-site advertising intended to be read only by customers in the on-site parking lot; and that, therefore, said sign is permissible and is not considered a wall sign as defined and discussed in the Sign OrdTnance. 4. That there are no exceptTonal or extraordinary circumstances or conditions applTcable to the property irtvotved or to the intended use of the property that do not apply generally to the property or class of use in thc same vicinity and zone. 5. That the requested variance is noc necessary for the preservation and enJoyment of a substantial property right possessed by other property in the same vicinity and zone. and den(ed to the propcrty in question. 6.
