WHEREAS, the City Planning Canmission did hold a public hearing at [he Ci[y Hall in the City of Anahetm on February 13, 197A, at 1:30 p.m., notice of sald public hearing having 6een duly given as reauired by lari and in accordance with [he provislons of the Anahelm Municipal Code, Chapter 18.03, to hear and consider evidence for and against sald proposed variance and to investiaate and na~e findings and recommendations in connection therewith; and WItEREAS. said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due co~sideration of all evidence and repor[s offered at said hearing, does find anJ determine [he following facts: PC78-28 ., I • ~ . 1. That the petitioner proooses a waiver of the folloa~t~y to perntt price signing on an r.xfsting free-standing pole sign: (a) SECTION 18.OS.OE9.022 - Maximum size of nrice siqns. 9 s uare feet servlce station price sign permTtted; 20 squa~ proposed) (b) SECTIONS 16.05.091 and 18.84.062.040 - Free-standinq sians in the SC Zone. Free-standing signs prohibited; expansion o an exfsting free-standing sign prooosed) 2. That the a6ove-mentioned waivers are hereby denied on the basis that the subJect property is located in the Scenic Corridor Zone Overlay and all adverttsing shall be in accordance with the re~iulations pertainin9 to outdoor advertising in said zone overlay; that the exlsting free-standing sign was constructed in connection wtth Variance No. 2307, the conditions of which specified that said sign would be for identification purposes only without prices; and that sub.Ject proposal ~vouid be an expansion of an existing nonconforming sign and would establish an undesirahle precede~t for subsequent similar proposals in the Scenic Corrtdor. 3. Tha[ there are no exceptional or extraorJinary circumstances or condi[tons applicable to the oroperty involved or to the in[ended use of the preperty that do not apply aenerally to the prnperty or class of use in the same vicinity and zone. 4. That the requested variance is not necessary for the preservation and enjoyment of a substantial praperty right possessed by other property in the same vicinity and zonc, and denied to the property in question. 5. That the reouested variance will be naterially detrinental to the pubiic welfare or injurious to the property or improvements in such vicinity and zene in which the proper[y ts located. 6. That no one indicated their presence at said public hearing in opposttion. ENVIRONMEIJTAL IMPACT FItIDING: The Planntng Director or fiis authorized representative has determined [hat the prooosed proJec[ falls ~+ithin the def(nition of Categorical Exempttons, Class it, as defined in Paragraph 2 of the Ci[y of A~aheim Environmental Imnact Report Gutdelines and ts, therefore, categorically exempt from the requirement to prepare an EIR. NOW. THEREFORE, BE IT RESOLVED that the Anaheim Lity Planning Lommission does hereby deny subject Petition for Variance on the basis of Che aforementioned findings.
