N0. 1918 BE GRANTED WHEREAS, the Anaheim City Planning Commisston did receive a verified Petition for Canditional Use Pcrmit from PARKS PROPERTIES, INC. 150 East Meda, Sulte 203, Glendora, Californla 90066, owner, and AJF LEASING, 2500 South Eas[ern Avenue, Los Angcles, Cslifornla 90040, ayent, of certain real property situated In the Ctty of Anaheim, Lounty of Orange, State of California, described as: Lots 5, 6, 7 and 18, of Tract No. Sh52, in the Ci[y of Anahcim, as per map recorJed Fe6ruary il, 1965 in book 211, pages i and 2, Miscellaneous Maps, in the offtce of the county recorder of said coun[y. WHEREAS, the Ctty Planning Commission did hold a public hearing at the Ctty Nall in the Clty of Anaheim on December 4, 1978, at 1:30 p.m., notice of said public hearing having been duly gtven as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 1$.03, to hear and consider evidence for and against said proposed conditional use and to investigate and make findtngs and recommendations in connection [herewith; and wNEREAS, said Commission, after due inspection, inves[igatton and study made by itself and fn Its behalf, and after due consideration of all evidence and reports offered at said hearing, does ftnd and determine the following facts: 1. That the proposed watver is hereby qranted on the basis that denial would be depriving subJect property of privileges being enJoyed by other property owners in the same zone and victnity. 3. That the proposed use will not adversety affect the adJoining land uses and the grow[h and development of the area in which ic is proposed to be located. 4. That the size and shape of the site proposed for the use is adequate to allov the full development ~f the proposed use tn a manner not detrimental to the particular area nor to the peace, health, safety, and general wetfare of the Citizens of ihe City of Anahelm. 5. That the granting of the Conditional Use Permit under the condittons imposed, lf any, wi11 no[ be detrimental to the peace, health, safety and general welfare of the Citlzens of the Ctty of Anaheim, PC78-287 6. That no one indlcated their presence at said public hearing in ~pposftlon; and that no correspondence was re~eived tn opposition to the subJect petition. EtIVIRONMENTAL IMPACT FINDING: That the Anahelm City Planning Canmission has reviewed the proposal to ~ermlt a trailer renial and leasing facility wfth a Naiver af required e~closure of outdoor uses on an irregularly-shaped parcel of land consisting of approximately 1.9 acres, having a frontage of approximately 111 feet on the south s(de of Vermont Avenue and a frontage of ?50 fec[ at the westerly terminus of Lacy Avenue, having a maximum depth of approxfmately 445 fee[ and being located approxtmately 625 feet west of the centerline of East Street; and does hereby approve the Negative Declaration from the requiremen[ to prepare an environmental tmpact report on the basis that there would be no slgnificant indivTdual cr cumulative adverse environmental impact due to the approval of thls Neoatlve Declaration since the Anahefn General Plan ~esignates the subJect property for general industriai land uses commensurate with the proposal; that no sensitive environmental impacts are involved in the proposal; tha[ the Initial Study submi[ted by Cha petitioner indlcates ~o significant individual or cumulative adverse envirornnental impacts; and that the Negative Declara[ion subsiantiating the foregoing findings is on file in the City of Anaheim Planning Depar:ment. NOW~ THEREFORE, BE IT RESOLVED [hat the Anaheim City Planning Cortmission d~es hereby grant subject Petition for Co~ditio~al Use Permit, upon the followfna condltlons which are hereby found [o be a necessary prerequisite to the proposed use of the subJect property in order to preserve the safety and generai weifare of the Citizens of the CI[y of Anahelm: BE IT FURTHER RESOL`JED that the Anaheim City Planning ~ommission does hereby find and determine that adoption of this Resolutio~ is expressly predicated upon applicant's compiiance wfth each and all of the condltions hereinabove set forth. Should any such condi[ton, or any part thereof, be declared invalid or unenferceable by the final judgmenc of any court of competent jurisdicttori, then this Resolution, and any approvals herein contalned, shall be deemed ~ull and void.
