PC78-1~5 11~ CQNIJECTION WITH COND1T1017lIL USE PERMIT ~IQ. 187l~. 41HEREAS, on August 14, 1978, thc Anahcim City Planning Commission by Resolution No. PC78-195 granted, in part, Conditional Use Permit No. t'u74; and k'HEREAS, applicant (Vince~t L. Toc{:, of Tait ~ Associates) has reviewed and takes exception to two ftens in Condition tlo. 5 of said resolution, speciftcalty the requirement for a 12-foot high screening fence along Santa Ana Stree[ and along [he southerly 110 feet of the east oroperty line alona Ol(ve Strcet; NHEREAS; the Pianning Coc+mission revierred their past action and verified [hat their tntent was to reauire the screeninq fence along Sanca Ana Str~e[ but that the screening fence along Olive Street was neant to be ten (10) feet lona instead of one hundred [en (110) feet; NOW, THEREFOP,E, BE IT RESOLVED that the Anaheim Clty Planning Commtssion does hereby amend Condition No. 5 of Resolutton No. PC73-195 to read as follows: 5. That subject propnrty shall be developed Substantially in accordance with pians and specifications on file with [he Ci[y of Anahcim marked Exhibit No. 1; provided, however, that the S~foo[ reauired landscaped setbacF: shail be proviJed along Claudina, Olive and Ellsworth Strects; and that 12-foot high chalnlink fencina interwoven wfth wooden slats shall be provicled behind the landscaped setbacks along Claudina, Oiive and Elisworth Streets, and along the northerly property li~e facing Santa Ana Street, and that the 12-foot high fenctna shall also be exte~ded approxima[cly iQ fect casterly from Claudina Street along the south prooerty l(ne and approximately in feec northerly from Ellsworth S[rcet alnng thc westerly property line along Qlive S;reet. BE IT FURTHER RESOLVED tha[ the Anahcim City Planning Commission does hcreby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with *_he condt[ton hereinabove set forLh. ~hould the condition, or any part thereof, bs declared invalid or unenforceable by [he ft~al judgment of any court of compete~t Jurfsdiction, then chis Resolution, and any approvals herein contained~ shall be deemed null and void.
