A RESOLUTION OF THE ANAHEIM CITY PLANNING
COAII+IISSION RECOMMENDING TO THE CITY COUNCIL
THE CLARIFICATION OF AN ANIBIGUITY IN THE
ANAHEIM MUN~CIPAL CODE.
WHEREAS, the City of Anaheim has heretofore
adopted a Municipal Code, Section 18.01.200 of which
cantains a definition of "story" for purposes of determin-
ing the number of stories in a building; an3
4~FiEREAS, said Section defines "story" as that
gortion of a building between the surface of any floor and
the surface of the floor next above it; and
WHEREAS, an ambiguity has been found to exist by
the Planning Commission in the meaning of the term "floor"
as used in said Section; and
WHEREAS, Section 18.02.041 of the Anaheim Municipal
Co3e provides with reference to such ambiguities that the
Planning Commission shall ascertain all pertinent facts and
by resolution set forth its findings and the reasons there-
for and such findings and rssolutions shall be referred to
the City Council and, if approved by the City Council,
thereafter such interpretations shall govern.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim City
Planning Commission as follows:
1. Th~t the PlanninE Commission does hereby find
that the term "floor" as used in the definition of "story"
set forth in Section 18.01.200 of the Anaheim ?dunicipal Code
includes exposed horizontal ,]oists which serve as, or are
capable of serving as, a useable base or lower sur£ace for
a portion of the building not less than six feet (E') in
hei~ht and flfty (50; square feet ].n area wnere said area is
directly open and accessible to other areas of the building.
2. The aforesaid finding is based upon a determina~
tion by the Planning Commission that such an area would, with
minor interior modifications and without the lmowledge or
consent of the City, be capable of human habitation and,
therefore, constitute an additional story of the building for
