PC78-4 A RESOLUTION OF THE A:dAHE1M CITY PIANNING COKMISSION THAT PETITt0~1 FOR LOND1T101~AL USE PERMIT ~10. 17~1 BE DENIED 41HEREAS, the Anaheim City Planning Commfssion did receive a verified Peti[ion for Conditional Use Permit from RtSSTIG MOTEL, ~i1F South Beach Boulevard, Anaheim, California, 92804, owner, of certain real nroperty situated in the Ctty of Anaheim, County of ~ran~e, State of California, describr_d as: The south 94.00 feet of thc north 329.52 feet ot the west 464.20 feet, measured along the south linc, of the south half of the southwest quarter of the southwesi quartr_r of Sectton 13, Township 4 South, Ranae il West, in the Rancho Los Coyo[es, in the Lity of Anaheim, County of Orange, State of Caiifornia, as per map recorded in Book 51. Page Ii of Miscellaneous Mans, in the office of the County Recorder of said County. EXCEPT the west 92.00 feet thereof. The east i-+2.00 feet of [he west 464.20 feet, measured along thc south line, of the south half of the southwest quarter of the southwest quarter of Section 13, township 4 South, Range 11 West, in the Rancho Los Coyotes, Lity of Anaheim, County of Orange, State of California, as per map recorded in book. 51, page 1T of Miscellaneous Maps, in the office of the County Recorder of said county. WFIEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on January 4, 197II, a[ 1:30 P•m., notice of said public hearing having 6een duly given as required by law and in accordance with the provisions of the Anaheim Hunicipal Code, Chapter 18.03~ to hear and consider evidence for and against said proposed conditional use and to inves[igate and make finc:inys and recortimendastons in connection [herewith; and WHEREAS~ satd Commtssion, after due inspec[ton, inve:stigatlon and study made by ttself and in its behalf, and after due consideratton of all evidence and reports offered at safd hearing, does flnd and determine the follor:tng facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by An~heim Municipal Code Section 18.hG.O50.tpp to wtt: to permit a recreational vehicle facility Tn conJunction wtth an er.isting motel. 2. That the proposed use Ts hereby denied o~ the basis that the size of subJec[ propert; does no[ permit adequate on-site vehicular circulation and turning space for large recreational vehicles, and that the proposal will have a potential adversA impact on nearby residential uses hecause of the increased trafftc and noise, 3. That the proposed use will adversely affect the adjointng land uses and the growth and development of the area in which tt is proposed to be located. 4, That the stze and shape of the site proposed for the u:;e is not adequate to allow the full development of the proposed use in a manner not de[rtmental to the particular area nor to the peace, health, safety. and generai welfare of the Ci[izens of the Clty of Anaheim. That two persons Indicated their presence at said public hearing In opposition, and a petition was presented containing signatures of 30 persons in opposition to subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anahetm City Planning Commlssion has reviewed subject proposal to permit a recreational vehicle facility in conJunctlon with an extstiny motel on an irregular)y-shaped parcel of land consisting of approximately 1.1 acres havin9 ~ frontage of approximately 4h feet on the east side of Beach Boulevard, having a maximum depth of approximately 375 feet. being located approximately 338 feet north of thc centerline of Ball Road~ and does hereby approve [he ~7egative Deciaration from the requirement to prepare an Pnvir~nmentai impact report on the basts that there rrould be no significant indTvtdual or cumulative adverse environmental impact due to the approval of Chis Negative Declaration since the Anaheim General Plan designates ihe suhJect property for general cor,mercTal and medfum-density residential land uses commensurate wtth the proposal; that no sensi[ive environmental impac[s are involved in the proposal; that the Initia) Study submitted by the petitioner indicates no signiftcant individual or cumulattve adverse environmenial impacts; and that the Negative Declaratton substantiating the foregoing findin9s is on file in tnc :ity of Anaheim Planning Depar:ment. NOW, THEREFORE. BE IT RESOLVED [ha[ thc Anahetm City Planning Commission does hereby deny subJect Petition for Conditional Use Permi[ on the basis of the aforementioned findings.
