WHEREAS, the Anahefm Lity Planni~g CommTssion did receive a verlfied petition for Reclassification from LEONARD J. ANO GERALDINE LAWICKI, 1676 Ord Way, Anaheim~ California 92802, owners, of certain real property situated in the C(ty of Anaheim~ County of Orange, State of Callfornia, described as follows: Lot 9 of Tract 2217 as per map recorded in Book 61~ Pages 30 G 31 of Miscellaneous Maps in the office of Che recorder of safd Orange County. WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on March 13, 1978, a[ 1:30 p.m.~ notice of said public hearing having been duly given as required by law and in accardance with Che provisfons of the Anaheim Municipal Code, Chapter 18,03, to hear and consider evtdence for and against said proposed reclassiftcation and to investigate and make findings and recommendations in connection therewith; and 41HEREAS, sald Commission, after due inspec[Ion, fnvestiga[ton and study made by itself and In its behalf, and after due constderation of all evldence and reports offered at said hearing, Joes find and determine the following facts: 1. That the petitioner proposes reclassificatlon of subject proper[y from the RS-7200 (Residen[fal, Stngle-Family) Zonc to the CL (Canmercial, Limiied) Zone. 2. That the Anaheim General Plan designates subject property for general commcrcial uses. 3. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper developmen[ of the community. 4. That the proposed reclassification of subJect property does properly relate to the zones and their permitted uses locally established in ciose proximity to subject property and to the zo~es and thelr permitted uses generaliy established throughout the community. 5. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subJect petition. ENVIRONMENTAL 1MPACT FINDING: That the Anahtim City Planning Cortmissio~ has reviewed the subJect proposa to rec assify the zoning from RS-7200 (RESIQENT~AL~ SINGLE-FAMILY) to CL (COMMERCIAL, LIMITED) and to convert an existing residen[ial structure into a real estate office wtth waivers of maximum structural height. minimum structurai setback abutting an arterial htghway, minimum structural setback abutting a residentlal zone and minimum number of parking spaces on a rectangularly- FC78-44 i ,' shaped parcel of ~and consisting of approximately 7260 square feet, located at the northwest corner of Sallie Lane and Euclid Street. having approximate frontages of 55 feet on the north side of Sallie Lane and 132 feet on the wesc side of Euclid Strect; and does hereby approve the Negative Declaratlon from thc requirement to prepare an environmental impact report an the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaratlon since the Anaheim General Plan designates the subJect property for general commercial land uses commensurate wfth the proposal; that no sensitive environmental impacts are involved in [he proposal; that the Initial Study submitted by the petitioner indicates no signi`tcant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the C?c; of Anaheim Planning Department. NOW~ THEREfORE, BE 17 RESOLVED that the Anaheim City Planning Commission does hereby grant subJect Petition for Reclassification and, by so doing, that Title 18-Zoning of the Anaheim Muntcipal Lode be amended to exclude the above-described property from the RS-7200 (RESIDENTIAL. SINGLE-fAMILY) 20~lE and to incorporate said described property into the CL (LONHERCIAL, LIMITED) ZONE upon the following conditions which are hereby found to be a necessary prerequistte to the proposed use of subject property in order to preserve Che safety and general welfare of the Citize~s of the Ci[y of Anaheim: 1, That sidewalks shatl be installed along Sallie Lane as required by the Ctty Engineer and in accordance with standard plans and specificatTons on file in the Office of the City Engineer, 2, That a 6-foot masonry wall shail be constructed alon9 the west Rroperty line. 3. That the existing structure shall be brought up to the minimum standards of the City of Anaheim, including the Uniform Butlding, Plumbing, Etectrical, Mechanical, and Fire Cod~s as adopted by the City of Anaheim. 4. The drlveway to Sallie Lane shaii be ~emoved and replaced w}[h 5tattdard curb and gutter and sidewalk. 5. That appropriate water assessment fees as determined by the Director of Public Utilities shall be paid to the City of Anaheim prior to the issuance of a building permit. 6, That the owner(s) o` subJect property shall pay to the City of Anaheim the sum of$3.50 per front foot along Euclid Street and Sallie Lane for tree plantTng purposes. 7. Prior to the introductlon of an ordinance rezoning subject property~ Condition No. 6, above-mentior.ed, shall be completed. The provtsions or rights granted by this resolution shall become null and void by action of the Planning Commtssion unless said conditiu~~s are complied with wlthin one year from the date hereof, or such further time as the Planntng Commission may grant. -2- PC78-~4 8. That Condition Nos. 1, 2,.3 and 4, above-mentioned, shall be complied wtth prlor co ftnal buildtng and zoning inspeccions.
