A RESOLUTION OF THE ANAHEIM CITY PLANNING CO'1MISSION
THAT PETITION FOR VARIANCE N0. 3000 BE DENIED
WHEREAS, the Anahelm City Planning Canmission dtd receive a verified
Petition for Variance from ASAWA CORPORATION~ 540 North Golden Circle Drive, Santa
Ana, California 92705, owner, of certain real property situated in the City of
Anaheim, County of Orange, State of California described as:
That portion of Tract No. 613, as shown on a map thereof recorded
in book 19. page 19, Hiscelianeous Maps, records of satd Orange
County, which lies East and South of a line described as follows:
Be9inning at an intersection of the Southerly line of said Tract
with the centerilne of the unnamed street, 40.00 feet wide,
adJoining said tract on the East; thence North 7° 16' 48" West
204.93 feet along said centerl(ne; thence South 80° Oi' 10" West
51.84 feet; thence South.82o43~ 12" West 109•35 feet to a point on
a non-tangent curve concave Northwesterly having a radius of 76.00
feet a radial to said polnt bears North 86° 37' 3Q" East; thence
Southwesterly 69.23 feet along said curve through a central angle
of 52° 11' 37": thence non-[angent fram said curve, South 1G° 48'
50" East 174.81 feet to the Southeasterly line of said tract;
thence Nor[h 73° 11' 10" East 167.48 feet along said Southeasterly
line to Che point of beginning. Excepting the Southerly 20 feet
as conveyed to the County of Orange for road purposes by deed
recorded February 2k, 1926 in Book 625, page 3s7, Deeds. Aiso
excepting all oit and other hydrocarbon substances, but without
the right to use any portion of said land lying above a depth of
500 feet from the surface thereof.
WHEREAS, the City Planning Commission dtd hold a public hearing at [he City
Hall in the City of Anaheim on March 13, 1978, at 1:30 p.m., notice of said public
hearing having been duly given as required by law and in accordance with the
provlsions of the Anaheim Municipal Code, Chapter 18.Q3, to hear and consider
evidencE for and against said proposed variance and to investigace and make findfngs
and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspeciion, investigation and study made
by itself and in its behalf, and after due co~sideration of all evidence and repor[s
offered at said hearing, does find and determine the following facts:
1. Tha[ the petitioner proposes a watver of the following to cor~struct a
free-standing sign:
SECTION tII.05.0~3.0231 - Minimum distance between free-standin si ns.
300 feet required; 5 eet proposed
2. That the above mentioned waiver is hereby denied on the basis tha[ the
pctitioner did not demonstrate that a hardship exists.
3. That subJect property is a smal~ commercial site wtth good visibiticy
along two arterial highrrays and there is no need for excessive signing.

4. That there are no exceptional or extraordinary ctrtumstances or
conditions applicable to the property invotved or to the intended use of the propcrty
that do not apply generally to the property or class of use tn the same vicinity and
zone.
5. ThaC the requested variance is not necessary for the preservation and
enjoyment of a substantial property ri9ht possessed by other property in the same
vicinity and zone, and denled to the property in question.
6. That the requested variance will be materially detrime~tal to the
public orelfare or tnjurious to tlie praperty or improvements in such vicinity and zone
in which the property is located.
7, That no one tndicated their presence at said pubiic hearing in
opposi[ton; and that no correspondence was received in oppositfo~ to the subject
petttion.
ENVIRONMENTAL IMPACT FINDING: The Planntng Director or his authorized
representaiive has determined that the proposed proJect fails within the definition
of Categorical Exemptio~s, Class 11, as defined in Paragraph 2 of the City of Anaheim
Envlronmental Impact Report Guidelines and ls, therefore, categorically exempt from
the requirement to prepare an EIR.
N041~ THEREFORE~ 6E IT RESOLVED that the Anahelm City Planning Cortmission
does hereby deny subJect Petition for Variance on the basis of [he aforementioned
findings.
THE FOREGOING RESOLUTION is signed and approved by me this 13[h day of
