PC78-48 A RESOLUTIOt~ OF TNE ANAHEIM CITY PLANNIt~G CO`1NISSION TNAT PETITION FOR CONDITIONAL USE PERMIT ND. 1806 BE DENIED WHEREAS, the Anaheim City Planning Cortmisslon did receive a verified Petition for Conditional Use Permit from DOROTHY SABEL, NILLIAH A., GLORIA M. AND GOLDIE BAYZERMAN, 6980 Knott Street, Buena Park, Lalifornia 90621, owners, and MARVIN H. GP.EENSPAN, 2002 Victoria Avenue, Anaheim, Catifornia 92804, agent, of certain real property situated in the City of Anaheim, County of Orange, State of California, described as: PARCEL 1: The North 135 feet of the South 330 feet of the West half of Lot 5 of Nelen and Lynch's Subdiviston, as shown on a map recorded in Book ~t~~2, page 158. Deeds, records of Los Angeles County, California. WHEREAS, the City Planning Commission dfd hold a public hearing at the City Hatt in the City of Anaheim on March 13. 1978. at 1:30 p.m., notice of said pub~ic hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.Q3, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in co~nection ther2with; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideratlon of all evidence and reports offered at said hearing, does find and determine the following facts: 1. Tha[ [he proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.44.05~•040 to wit: to permit a massage parlor. 2. That the proposed use, wheretn employment is limited to persons eighteen years or older, will adversely affect the adjoining and nearby land uses which constst of a church, school. a city park and numerous famfly-type restaurants, and will also adversely affect the arowth and devefopment of the area in whtch lt is proposed to be located. 3• That there are a sufficient number of similar es[ablishments tn close proximity to subject location to serve the needs of the community and the granting of the Conditlonal Use Permit will be detrinental to the peace, health, safety and general ~relfare of the citizens of the City of Anaheim. 4. That l3 persons indicated thrir presence at said public hearing in oppositlon; and that correspondence was receive~ in oppositlon to the subject petition; and a petition containing app~oxtmately 85 signatures was recetved in opposition, ENVIRONMEN7AL IMPACT FiNDING: The Planning Director or hts authorized representative has determined that the proposed proJect falls within the definition of Categorical Exemptions, Classes 1 and 3, as defined in Paragraph 2 of the City of Anaheim Environmental impact Report Guldelines and is. therefore, categorically exempt from the requirement to prepare an EIR.
