WHERE~,S~ [he City Planning Commission did hold a public hPartng at the City
Hall in the City of Anaheim on January 4, 197E, at 1:3~ P•m „ notice of said public
hearing having been duly given as required by law and in accordance with the
provisions of the Anahelm NunTcipal Code. Chapter 18.03, to hear and co~sider
evidence for and aaai~st said proposed co~ditional use and to tnvestlgate and make
findings and recommendacions in connection therewith; and

by itself and tn its behalf~ and after due consideration of all evidence and reports
offered at said hearing, does find and detcrmine the following facts:

1, That the proposed use is properly one for which a condltional use
permit is authorized by Anaheim Municipal Code Section 1$.1+4.050.010 to wit: to
permit on-sale heer in a proposed billiard center.
2, That the proposed use is hereby denied on the basts that because the
existing shopping center was developed prtor to the Planning Carmiisslon's established
policy requiring a 20-foot wtde landscaped buffer between single-family residentlal
areas and commercial use. no provlsion was made to adequately protect the nearby
residences; and that, therefore. the proposal will po[entialty create increased noise
and traffic which will be detrlmental to the adJacent residential area.
3, That the proposed use will adversely affect the adjointng land uses and
the growth and development of the area in which it is proposed to be located,
4. That the size and shape of the site proposed for the use is not
adequate Co allow the full development of the proposed use in a manner not
detrimental to the particular area nor Lo the peace. health, safety. and general
welfare of the Citizens of the City of Anaheim.
5, Tha[ the granting of the Conditional Use Permit will be detrimental to
the peace, health, safety and general welfare of the Citizens of the City of Anaheim.
6. That five (5) persons indicated their presence at sald public hearing
in opposition, and oneletter containing 15 signatures of properly ovmers was recelvea
in opposttion to the subJect petition.
ENVIRONMENTAL IMPACT FINDIN~: The Director of the Planning Department has
determined that the proposed activity falls r+ithin the definition of Section 3.01,
Ll~ss 1, of the City of Anaheim Guidetines to the Requirements for an Environmental
Impact Report and is, [herefore, ca[egoricaily exempt from the requirement to ftie an
EIR.
NOW. THEREFORE, BE IT RESOLVED that the Anaheim City Pfanning Lommission
does hereby deny subJect Petition for Conditional Use Permic on the basis of the
aforementioned findings.
THE FOREGOING RESOLUTION is signed and approved by me t:~is 4th day of
