WHEREAS, the Anaheim City Planning Commission did receive a veriffed

WHEREAS, the Lity Pianning Comn(ssion did hold a public hearing at the City
Hall in the City of Anaheim on March 27, 1978. at 1:30 p.m., notice of said publtc
hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Hunicioal Code, Lhapter 18,03, to hear and constder
evidence for and against said proposed reclassification and to investigate and make
findings and ~ecommendations in connection therewith; and
WNEREAS, said Commission, after due inspection, investigatton and study made
by i[self and in its behalf, and after due consideration of all evidence and reports
offered at said hearing. does find and determine the following facts:
1. That the petitioner proposes reclassification of Portlon A of subject
property consisting of approxfmately 4.5 acres located at the southwest corner of
Orangewnod Avenue and Rampart Street, from the PR (PUBLIC RELREATION) to the CL

(COMMERCIAL, LIMITED) Zone; and of Portion B consisting of approxtmately 11.3 acres
with approximate frontage of 670 feet on the wes[ side of Rampart Street. from the PR
(PUBL~C RECREATION) to the CO (COMMERCIAL, PKOFESSIQ~iAL) ZonP.
2. That although the Anaheim General Ptan currently designates subject
property for general industrial land uses, the City Planning Cortmisston has
recommended approval of General Plan Amendment No. 145 to the City Councii
desi9nating subJect property for commercial recreation and general commercial land
uses.
3. That the proposed reclassification is hereby granted subJect to the
petitioner's stioulation to provide trees of sufficient size (24" to 36" box) to
visually buffer the subject property along the south and west property lines.
4. That the proposed reclassification of subject property is necessary
and/or desirable for the orderly and proper development of che community.
5. That Lhe proposed rectassifica[ion of subJect property does properly
relate to the zones and the3r permitted uses locally established in close proximity
to subject property and to the zones and their permi[ted uses generally established
through~~ut the community.
6. That the proposed reclassifica[ion of subject property requires the
dedication and improvement of abutting streets in accordance with the Circulation
Element of [he General Plan, due to the anticipated increase in traffic wnich will be
generated by the intensification of land use.
ENVIROtIMENTRL IMPACT FIHDI~IG: That [he Anaheim City Planning Commission
considered on this date dra t EIR No. 213 for the reclassification to commercial
zoning of property located southwes[ of the intersection of Orangcwood Avenue and
Rampart street and ihat evidence, both written and oral, having been presented to
supplement draft EIR No. 213; the Planning Commission finds that potenttal
significant adverse impacts which could result from the projec[ location with respect
to the flood plain and the noise impact on the residential uses in the mobile home
park south of the proJec[ area may be mitigated by appropria[e grading, site layout,
structural design and landscape buffering. Specific pians indicaiing these
mitigation measures shatl be approved by the Planning Commission prior to the
issuance of bullding or grading permits. The Planning Canmtssion finds that draft
EIR No. 213 conforms to the California Environmental Quali[y Act and to Lity and
Sta[e EIR Guidelines and therefore, based upon the above considerations, the City of
Anaheim Planning Commission does certify EIR No. 213.
NOW. THEREFORE~ BE I7 RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Reclassification and~ by so doinn, that Titie
18-Zoning of the Anahetm Muntcipal Code be amended to exclude the above-described
property from the PR (PUBLIC RECREATION) ZONE and to incorporate said described
property for Portion A Into the CL (COMMERCIAL, LIMITEO) 20NE, and Portion 8 into the
CO (LOMMERCIAL. PROFESSIONAL) 20NE, upon Lhe folloHTng conditions which are hereby
found to be a necessary prerequisits to the proposed use of subJect property in order
to preserve the safety and general welfare of the Citizens o~ the Lity of Anahein:
1, That the owner(s) of subJect property shall deed to the Lity of Anaheim
a strip of land 32 feet tn width from the centerline of the street along Stadium uay
for street widening purposes.

2, That all engineering requtrements of the City of P.nahelm along Rampart
Street and Stadium Way tncluding preparatlon of improvemen[ plans and in=tallation
of a11 improvements such as curbs and gutters, sidewatks, st~eet gradiny ana paving,
drainage faciltties or other appurtenant work, shall he complied with as requlred by
Lhe City Engineer and in accordance with standard plans and specificatiorts on file in
the Office of the Clty Engineer; that street lighting facilitles along Rampart Street
and Stadium way shali be installyd prior to final bullding and zoning inspections
uniess otherwise approved by the Director of Publlc Utilities; and/or that a bond.
certlficate of ueposit, ietter of credit, or cash, tn an amount and form satisfactory
to the City of Anaheim shall be posted with the Ctty to guarantee the t~stallation of
the above-mentioned requireJnents.
3, That sidewalks shall be installed along Orangewood Avenue as required
by the Lity Engineer and in accordance rrith standard plans and specifications on file
in the Office of the City Engineer.
4. That the owner(s) of subject property shall pay to the City of Anaheim
the sum of 60 cents per front foot along Orangewood Avenue, Rampart Street and
Stadium Way for tree planting purposes.
5, That trash storage areas shall be provided in accordance with approved
plans on file wlth the Office of thP Dtrector of Public Works.
6. That fire hydrants shali be instalied and charged as requlred and
determined to be necessary by the Chief of the Fire Department prior to commencement
of str~ctural framing.
7, That subject property shall be served by under9round utilittes.
8. That draina9e of subject property shall bc disposed of in a manner
satisfactory to the City Engineer.
g, In the event that subject property is to be divided for ihe purpose of
saie, lease, or ftnancin9, a parcei map, [o recard che appraved dlvlsiort of subJect
property shall be submi[ted to and approved by the City of Anaheim and [hen be
recorded in the office of the Orange County Recorder.
10. If permanent strect name signs have not bcen installed, temporary
street name stgns shall be installed prtor to any occupancy.
11, That appropriate water assessment fees as determined by the Direc:or of
Public Utilities shall be paid to the Ci[y of Anaheim prior to the issuance of a
building permit.
12, That the developer shall obtain a favorable flood hazard letter.
acceptable to the City of Anzheim, from the Qrange County Flood Control District
prior to the issuance of a buitding permit.
13, That a tree buffer shali be ptanted along the south and west property
lines and shall minimally consist of trees in 24-inch by 36-inch boxes.
14. Tha[ prior to the Issua~ce of buildtng permits. specific plans shall be
submttted to the Planntng Commission for review and approval, said plans showing Che
method of sound attenuation to protect the mobile home park to thc south from the
potentia! noise ge~erated by subject property.

15. Prlor to the introduction of an ordtnance rezoning ~ubject property,
Conditlon Nos. 1, 2, 4 and g~ above-mentioned, shall be complet~d, 7he provislons or
rights granted by this resolution shall become null and void by action of the
Planning Commission unless said conditlons are complied with within one year from the
date hereof, or such further time as the Planning Commission may grani.
16. That Condition Nos. ;, 5, 7. and 8, above-mentioned~ shall be complied
with prior to final buildin9 and zoning inspections.
