THAT PETITION FOR RECLASSIFILATION N0. 77-78-51 BE GRANTED.
1~IHEREAS. the A~aheim City Planning Lommission did recetve a verified
petition for Reclassification from FLOSSIE C. HE1N~ 610 South Sunkist Street,
Anaheim, Caltfornia 32806, a+ner, and V. W. "FLIP" Flippen, P. 0. Box 6097, Anaheim,
Caltfornia 92803, agent, of certafn real property situated in the CTty of Anaheim~
County of Orange, Statc of Callfornia~ described as follows:
THE SOUTH 2O0.00 FEET OF THE WEST 120.00 FEET (MEASURED TO THE
CENTER LINES OF STREETS ADJOINING) OF LOT 3 OF HEIN'S SUBDIVISION
IN THE CITY OF ANAHEIM, LOUNTY OF ORANGE, STATE OF CALIfORNIA, AS

WHEREAS~ the City Plannin9 Lommisstan did hold a publtc hearing at tne City
Hatl in the City of Anaheim on March 27. 1978, at 1:30 p.m.~ notice of said public
iiearing having been duly given as required by law and in accordance with the
provislons of the Anahetm Municipai Code~ Chapter 18,03. to hear and consider
evtdence for and agalnst said proposed reclassification and to investigate and make
findings and recommendatio~s in connection thereHith; and
WHEREAS. said Commission, after due Inspection, investigation and study made
by itself and in its behalf, and afcer due consideration of ali evidence and reports
offered at said hearing, does ftnd and determine the following facts:
1. That the peticloner proposes reclassification of subJect property from
the RS-A-43,000 (Residential~ Agricultural) to the RS-5000 (Residential. Single-
Famlly) Zone.
2. That the Anahelm General Plan des(gnates subJect property for low-
density residential land uses.
3. That the proposed reclassiflcation is granted on the condltion that the
proJect will be de~eloped substantially In accordance with the plan presented to the
Pianning Commission.
4. That the proposed reclassifica[lon of subJect property is necessary
and/or desirable for the orderly and proper development of the community.
5. That the proposad reclassTfTcation of subJect property does properly
relate to the zones and their permitted uses locally establTshed In clos~ proxlmity
to subJect property and to the zones and their permTtted uses generally established
throughout the cortmuntty.
6. That the proposed reclasstficatlon of subJect property requires the
dedtcation and tmprovement of abutting streets in accordance with the Circulatlon
Element of the General Plan. due to the anticipated tncrease in [rafflc whtch will be
generated by the l~tenstfication of land use.

ENViRONMENTAL IMPACT FINQING: Tha[ the Anaheim Ctty Planning Commission has
reviewed the subJect proposal to reclassify the zoning from the RS-A-43,000
(RESIDEPITIAL~ AGRICULTURAL) to the RS-5000 (RESIDEWTiAL, SINGLE-FAMILY) Zone to
establtsh a 2-lot, RS-5000 subdivision with waiver of the the rcquirement chat
single-family structures rear-on ar[erial highways on a rectangularly-shaped parcel
of land consisting of approximately 0.26 acre located at [h~ northeast corner of
South Street and Sunkis[ Street, having approxTmate frontages of 75 feet on the north
side of South Street and 155 feet on the east side of Sunkist Street; and does hereby
approve the Negative Declaratlon from the requirement [o prepare an environmental
impact report on the basis that there vrould be no si9niftcant individual or
cumuiative adverse environmenLal impact due to the approval of this Negattve
Declaration since the Anaheim General Plan destgnates the subJect property for low-
denstty residential land uses commensurate with the proposal; that ne sensitive
environmental impacts are involved in the proposal; that the Initial Study submitted
by the petitioner Tndicates no stgnificant individual or cunulative adverse
environmental impacts; and that the Negative Dectaration substantiattng the foregoing
findings is on file in the City of Anaheim Planning Depar[ment.
NOW~ THEREFORE, BE IT RESOLVED that the Anahcim City Planning Commission
does hereby grant subject Petttion for Reclassification and, by so doing~ that Titie
18-Zoning of the Anaheim Municipal Lode be amended to exciude the above-described
property from the RS-A-b3,000 (RESIDENTIAL/AGRICULTURAL) ZONE and to incorporate said
described property i~to the RM-5000 (RESIDEtITIAL, SINGLE-FAMILY) ZONE upon the
follow(ng conditions whicfi are hereby found to be a necessary prerequisite to the
proposed use of subjec[ property in order to preserve the safety and general welfare
of the Citizens of the City of Anaheim:
~, That street lighting facillttes along South Street and Sunkist Street
shall be installed prior to final buildtng and zoning inspections unless otherwise
approved by the Director of Pubfic Utfiiti~s, and in accordance with s[andard
specificattons on file in the Office of the Dlrec[or of Public Utiltties; and/or that
a bond, certificate of deposit, letter of credit, or cash, in an amount and form
satTsfactory to the City of Anahetm shall be posted with the City to guarantee the
i~stallation of the above-mentioned requirements prior to final occupancy.
2, That the owner(s) of subject property shall pay to the City of Anaheim
the sum of 60 cents per front foo[ atong South Strect and Sunkist Street for tree
planting purposes.
3. That drainage of subJect propercy shall be disposed of in a manner
satisfactory to the City Enoineer.
4. In the event that subJect property is to be dlvided for the purpose of
sale, lease, or financTng. a narcel map, to record the approved division of subject
property shall be submitted to and approved by the City of Anaheim and then be
recorded in the office of thr. Orange Lounty Recorder.
5, That the owner of subJect property shall pay [o the City of Anahelm the
appropriate park and recreaiion in-lieu fees as determined to be appropriate by the
City Council, said fees to be pa!d at the time the buiiding permit is issued.

6. That all tots ~ithTn this tract shall be served by underground
utilities.
7. That appropria[e water assessment fees as determined by the DTrector of
Public Utilities shall be paid co the Lity of Anaheim prior to the issuance of a
building pcrmit.
8. Prior to the introductlon of an ordinance rezoning subject property,
Condition Nos. 1 and 2, above-ment(oned, shall be completed, The provisions or
rights granted by tlifs resolution shall become nuli and void by action of the
Planning Commtssion unless said condittons are complied with wlthin one year from the
date hcreof, or such further time as [he Planning Commission may grant.
9. That Condttion Nos. 3 and 6, above-mentioned, shall be camplled with
prior to final building and zoning inspections.
THE FOREGOING RESOLUTION is signed and approved by me this 27th day of
