NHEREAS, the Anaheim City Planning Commission did reeelve a verified

Hall in the City of Anahe'~n on March 27, 1978, ~t ~~30 p.m., notice of sald public
hearing hav(ng bPen duly given as required by laa and in accordance Hiih the
provisions of the Anahe(m Municipal Code~ Chapter 18.03. to hear and consider
evidence for and against said proposed varia~ce and to investigate and make ftndtngs
and recanmendattons in connection therewith; and
WNEREAS. said Commission, afcer due inspection~ investlgatlon and study made
by itself and in its behalf. and after due constderatfon of all evidence and reports
offered at satd hearing, dces find and determine the following facts:
1. That the petltioner proposes a waiver of the followTng to establish a
2-lot RS-5000 subdivision:

2. That the above-mentioned walver is hereby gra~tcd on the basis that thz
petitioner dcmonstrated that a hardshlp exists due to the size and shape of the
property which already fronts-on an arterTal hTghway.
3, That there are exceptional or ex[raordTnary cTrcumstances or conditions
applicable to thc property involved or to the Intended use of the proper[y that do
not apply generally to the property or class of use in the same vicintty and zo~e.

4, Tha[ the reques[ed variance is necessary for thc preservatton and
enjoymen[ of a subs:antial property right possessed by other property in the same
vicinity and zone, and denied to the property in question, because other nearby
re,idential lots arc currently developed with dwellings fron[ing-on the same arterial
highway.
5. That the requested variancc will not be matertally de[rimental to the
public welfare or injurious io the property or improvements in such vicinity and zone
in which the property is located.
6. That no one (ndicated their presence at said public hearing in
opposition; and Chat no correspondence was received in opposition to the subject
peti[ion.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Piannina Commfssion has
reviewed the subject proposal to reclassify the zoning from the RS-A-43~000
(RESIDENTIAL/AGRILULTUP4L) [o the RS-5000 (RESI~ENTIAL. SINGLE-FAMILY) Zone to
establish a 2-lot. RS-5000 sub~sivtsiort xi[h xaiver ef the requirement that single-
family struciures ~ear-on arterta) highways on a rectangularly-shaped parcei of tand
consisting of approximately 0.26 acre located at the northeast corner of South Street
and Sunkist Street. having approxir~a[e frontages of 75 feet on the north side of
South Street and 155 fect on the east side of Sunkist Street; and does hereby approve
the Me9ative Declaration report on [he bssis that Chere would be no significant
indlvidual or cumulative adverse envTronmcntal impaci duc to the approval of this
Negative Declaratlon since the Anaheim General Plan designates the subJeci property
for low-density residential land uses came~surate with the proposai; that no
sensitive environmental tmpacts are involved in the proposal: that the Initial Study

environmen[al impacts; and that the Negative Declaration substantiatTng the foregoin4
findings Is on fTle in the City of Anaheim Planning Department.
NOW, THEREFORE. BE IT RESOLVED that the Anaheim LTty Planning Cammission
does hereby grant subjece PetTtton for Variance. upon the folla+ing conditlons which
are hereby found to be a necessary prerequisTte to [he proposed use of the subject
property in order to preserve the safety and general welfare of the CTttzens of the
City of Anaheim:
i. That this VarTance is granted sub}ect [o the campletion of
Reclassification No. 77-78-51, now pending.
2. Thac subjec[ property shall be developed substa~tially In accordance
with plans and specifTcattons on file with the City of Anahelm marked Exhibit Nos. i
through 3.
