A RESOLUTION OF THE ANAHEIM CITY PLANNING LOMMISSION
THAT PETITION FOR RECLASSIFICATION N0. 77-78~53 BE GRANTED.
WHEREAS, thc Anahelm City Planning Commisston did receive a verified
petition for Reclassif~ ~tion from E. 0. RODEFFER, 1720 East Garry Street, Suite 106,
Santa Ana, California 92705, owner, and HARRY C. SCHREY, 1720 East Garry Street.
Suite 106, Santa Ana, California 92705, agent, of cerCafn real property sttuated in
the Ctty of Anaheim, County of Orange. State of Californla, described as follows:
That portion of the Nest half of of the Northeast quarter of
Section 1, Township 4 South. Range 11 West, in Rancho Los Coyotes,
in the Lity of Anaheim, acquired by the Sta[e of Californla, by
Parcel i of Deed 1281, recorded in book 3875, page 95 of Officlal
Records Tn the office of the County Recorder of said Gounty,
bounded Southerly and Southeasterly by the following described
line: Beginning at thc Southerly terminus of ihat ceriain course

Hatl in the City of Anahetn on March 27, 1978, aL 1:30 p.m „ notict of said pub)lc
hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Munfcipal Cade. Chapter 18.03, to hear and consider
evidence for and against said proposed reclassificatlon and to investigate and make
findings and recommendatlons in connectfon therewith; and
~HEREAS, said Commission, aftcr due inspection, investigatton and study made
by itself and in its behatf~ and after due consideration of all evidence and reports
offered at said hearing, does find and detarmine the following facts:
1. That the petitioner proposes reclass'fication of subJect property from
the RS-A-43,000 (Residential/Agricultur~l) and ML (Industrial~ Limited) Zones to the
ML (Industrial, Limited) Zone.
2. That the Anahelm General Plan designates subJect property for general
Industrial use.
3. That the proposed reclasslfication of subJect property ts necessary
and/or desirable for the orderly and proper devetopment of the community.

4. That the proposed reclassification of subject proper[y doe~ properly
relate to the zones and their permitted uses locally established in close proximity
to subject property and to the zones and their permitted uses generally established
throughout the community.
5. That no one indlcated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to the subJect
petition.
ENVIROt~ME~J7AL IMPACT FINDING: Tha[ the Anaheim City Planning Commission has
reviewed the subject proposa to reclassify the zoning from the R5-A-43.000
(RESIDENTIAL/AGRICULTURAL) and ML (itIDUSTRIAL, IIMITED) zones to the ML (I4DUSTRIAL,
LIMITEO) zone to permit a racquetball facility on an irregularly-shaped parcel of
land consisting of approximately 0.6 acres, having a frontage of approximately 228
feet on the east side of Dale Avenue. having a maxtmum depth of 262 feet, and being
located approximately 645 feet south of the cen[erline of Orangethorpe Avenue; and
does hereby approve the Negative Declaration report o~ the basis that there would be
no significant individual or cumulattve adverse environmental impact due to the
approval of this Negative Declaratfon since the Anaheim General Plan designates the
subject property for general industrlal land uses commensurate with the proposal;
that no sensitive environmental impacts are invotved in the proposal; that the
Initial Study submitted by the Petitioner indicates no signtficant individual or
cumulative adverse environmental impacts; and tha[ the Ne9ative Declaration
substantiating the foregoing findings is on file in the City of Anaheim Planning
Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subJect Petition for Reclassification and, by so doing, that Title
18-Zoning of the Anaheim Municipal Code be amended to exclude the above-described
property from the RS-A-43,000 (RESIDENTIAL/AGRICULTURAL) and ML (INDUSTRIAL, LIMITED)
ZONES and to incorpora[e said described property into the ML (INDUSTRIAL, IIMITEO)
ZONE upon the following conditions which are hereby found [a be a netessary
prerequisite to the proposed use of subJect property in order to preserve [he safety
and general welfare of the Litlzens of the City of Anaheim:
t. That trash storage areas shall be provided in accordance with approved
plans ~n file with the OTfice of the Dlrector of Public Works.
2. That fire hydrants shall be installed and charged as required and
determined to be necessary by the Chief of the Ftre Department prlor [o commencement
of structural framing.
3. That subject property shall be served by underground utilitles.
4. That drainage of subJect property shall be disposed of in a manner
satisfactory to the City Engi~eer.
5, That appropriate water assessment fees as determined by the Director of
Public UtilTties shall be pald to the City of Anahetm prlor to the issuance of a
building permlt.

6. That ConditTon Nos. 1, 3 and 4~ above-mentioned, shall be canplied with
prtor to finai building and zoning inspections.
