RESOLUT~ON OF THE ANAhEIM CITY PLANNIH~ COMMISSION
THAT PETITION FOR VARIANCE N0. 3^C1 BE GRANTED
WHEREAS. the Anaheim City Planning Commission did receive a verified
Petitlon for Variance from RHYS E. AND LAUREL E. WILLIAMS, 1131 South Clarence
Street, Anaheim, Calltornia yZOUb, owners, and HI-L~ CONSTRUCTION, II~C. ,10865 Beach
Boulevard, Stonton, California 90680, (ageni) of certain real property sltuated tn
the City of Anaheim, Cou~ty of Orange, State of California described as:
Lot 20 of Tract No. 6512. as shown on a Map recorded in Book 249,
Pages 34 and 35 of Miscellaneous Maps, in [he office of the County
Recorder of said Orange County.
WHERERS. the Lity Planning Commiss'on did hold a public hearing at the City
Hall (n the Gity of Anaheim on March 27, 197E, at 1:30 p.m., notice of said pubiic
hearin9 having been duly yiven as required by law and in accordance wlth the
provisions of the Anaheim Municipal Code, Chapter 18.03, to hcar and consider
evidence for and against said proposed varia~ce and to Inves[tgate and make findtngs
and recommendations in connection therewith; and

by itseif a~d in i[s behalf, and after due consideration of all evidence and reports
offered at said hearing. does find and determine the foliowing facts:
i, That the petltioner proposes a waiver of the foliowing to construct a
family room addition to an existing single-family structure:

2, That Lhe above-mentioned waivcr is herehy ara~ted on the basis that the
pe[itioner demonstrated that a hardship exists in that similar variances have been
granted in the immediate vicinity and, therefore, this property would be denied
privele9es currently enJoy~d by other proper[tes in the same vicinity and zone.
3. That there are exceptio~al or extraordinary circumstances or conditions
appticable to the property involved or to the in[ended use of [he property that do
not apply generally to the property or class of use in the same vicinity and ~one.
4. That the requested variance is necessary for the preservation and
enJoyment of a substantial property right possessed by other property in the same
vicinity and zone, and denied [o the property in ques[ton because the tract in which
subJect lot is located was originalty developed under previous RS-5000 standards
which permitted 40°0 lot coverage and some lots have been so devetoped.
5. That the requested vartance will not be materially detrimencal to the
public welfare or inJurious to the property or improvements tn such vicinity and zone
in which the proparcy is locaced,
6. That no one indicated their presence at said public hearTng In
opposition; and that no correspondence was received in oppositlon to the subJect
peticion.

ENVIRONMENTAI IMPACT FINDING: The PlannTng Director or his authorized
representative has determined that the proposed proJect falis withi~ the definitton
of Categorical Extmptlons. Classes 1 and 3. as deftned In Paragraph 2 of the City of
Anaheim Environmentat Impact Report Guidelines and is. therefore, categorically
exempt from the requirement to preuare an EI?.
NOW, THEREFORE. BE IT RESOLVED [hat the Anahelm Clty Planning CommTssion
does hereby grant subject Petition for Variance~ upon the following conditions Hhich
are hereby found to be a ~ecessary prerequisite to the proposed use of the subject
property in order to preserve the safety and oenerai welfare of the Citizens of the
Clty of Anahelm:
i. That subject property shatl be devcloped substantially in accordance
w(th plans and speciFicatlons on file with the City of Anaheim marked Exhibi[ Nos. 1
and 2.
2. That Condttion No. 1, above mentioned~ shall be complied with prior to
final building and zoning inspections.
