ASANA, 540 North Golden Circle Drive ~114, Santa Ana, Caiifornla 92705. agcnt, of certain real property sftuated tn the City of Anaheim, County of Orange, State of California, described as: Lot 27, Tract 9144, as per map recorded October 29, 1976, in book 388, pages 28 to 30 inclusfve of Miscellaneous Maps, in the office of the County Recorder of sald Coi~nty. WHEREAS~ the City Planning Commtssion did schedule a public hearing at the City Hall in the City of Anaheim on March 13, 1978, at 1:30 p.m., notice of said public hearfng having been duly given as required by law and tn accordance wtth the provisio~s of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and a9ainst said proposed conditto~ai use and to investigate and make findings and recortmendations !n connection thereNith; said public hearing having been continucd to thc Planning Commission meecing of April 10, 1978; and WHEREAS, said Commission, after due inspection, investigation a~d study made by i[self and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: i. That the proposed use is properiy one for which a conditional use permit is authorized by Anaheim Munlcipal Code Sectfon 18.44.050.950 to wit: to permi[ a ve[erinary hospital for small animals with a waiver of: SELTlON 18.06.054.Q20 - Minimum number of arklno spaces. 32 snac~s required; 19 spaces proposed) 2. That the proposed use is hereby granted subject [o the foilowing stipulations by the petitioner: a. Tha[ there wili be only one vehicular access driveway from subJect property and the adJacent commercial properties onta Rio Grande Drive, and ft shall be aligned with Donna Court to the north; that the speclfic configuration of said driveway shall be approved by the Trafftc Engineer; and tha[ any revised circula[Ion plans for subJect propcrty and the adjacent commerctal properties shall be reviewed and approved by ihe Planning Commisslon. b. That the landscaped median in Santa Ana Canyon Road shall be closed prtor to the comple[ion of the access driveway [o and from Santa Ana Canyon Road. 3. That the requested walver, above-mentToned, ts hereby gra~ted on the basis that testimony presented at the public hearing indicates that the proposed use wtll not generate the need for as many parking spaces as requlred by Code for typical PC78-64 retail stores and service businesses, and that the proposed veterinary hospital will be part uf a larger commercfal complex in which the parking area will serve several separate commercial businesses. 4. That the proposed use wfil not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located, in that all activities shall be conducted wholly instde the butlding. 5. That the size and shape of the site proposed for the use is adequate to aliow the full development of the proposed use in a manner not detrimental to [he particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 6. That the granting of the Conditionai Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 7. That six (6) persons indicated their presence at said public hearing in oppositlon; and that no correspondence ~aas received in opposition to the subject petition. Et~VIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Cdrcnission has reviewed the subject proposal consisting of a veterinary hospital for smalt animals with a waiver of minimum number of parking spaces on an irregularly-shaped parcel of land consisting of approximately 1.1 acres having a frontage of approximately 25 feet on the northwest side of Rio Grande Drive, having a maximum depth of approximately 432 feet, and being located approximately 600 feet west of the centerline of Fairmont Boulevard; and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact repor[ on the basis that there would be no significant individual or cumulattve adverse environmental impact due to the approval of this Neaative Declaration since the Canyon Area General Plan designates the subJect property for 9eneral commercial and low denstty residential land uses commensurate with the proposal; that no sensltive environmental impacts are i~volved in the proposal; that the Ini[tal Study submitted by the petitioner indicates no significant individuai or cumufative adverse environmental impacts; and that the Negative Declaration substantlating the foregotng findings is on file in the Ctty of Anaheim Planning Department. NOW, THEREFORE. BE IT RESOL~'ED that the Anaheim City Pfanning ComnissTon does hereby grant subject Petition for Conditional Use Permit, upon the foilowing conditions which are hereby found to be a ~ecessary prerequisite to the proposed use of the subjecc prop~rty in ordcr to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. ihat trash storage artas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 2. That fire hydrants shall be installed and charged as required and determined to be rtecessary by the Chief of the Fire Department prtor to commenceme~t of structural framing. 3. That subject propcrty shall be served by underground utilities. 4. That drainage of subJect property shall be dtsposed of in a manner satisfactory [o the City Englneer. -2- PC78-64 5. In the event that subJect property ts to be divlded for the purpose of sale. lease, or financing, a parcel map. to record the approved division of subJect property shsil be submitted to and approved by the City of Anahetm and then be recorded in the office of the Orange County Recorder. 6. That appropriate water assessment fees as determined by the Director of Public Utilities shall be paid to the City of Anaheim prior to che issuance of a building permit. 7. The existtng power poles on subJect proper[y shall be removed and the lines installed underground as approved by the Director of Pubtic Utilitles. 8, Tha[ the devcloper of sutrJect property shall purchase the remnant parcel of property which is loca[ed between the subJect property and Santa Ana Canyon Road. 9, That a minimum 10 foot wide equestrian and hiktng trail easement shall be provided (n accordance with the Canyon Area General Plan and shall be dedicated to the City of Anaheim. 10. That the developer provide an access easement on subJect property for the use by thc adJacent propcrty to the west. 11. That subject property shall be developed substantially in accordance with plans and specifications on ftie wtth the City of Anaheim marked Exhibit Nos. 1 through 5, provided, however. that equestrian and hiki~g trails shall be constructed in accordance wtih the Canyon Area General Plan. 12. That Conditlon Nos. 5, 8. 9 and 10, above-me~tioned, shalt be comolied with prior to the comme~cement of the activity a~thorized under this resotution, or prior to the time that the buildtng permit is issued~ or within a period of one year from date hereof~ whichever occurs first. or such further time as the Planning Cor.mission may grant. i3.
