WHcREAS, the City Planning Commission did hold a public hearing at [he Lity
Hail in the City of Anahetm on April 10~ 1978, at 1:30 p.m., notlce of said publlc
hearing having been duly given as required by law and tn accordance with the
provistons of the Anaheim Munictpal Code, Chapter 18.03, to hear and consider
evidence for and against sald proposed conditfonal use and to inves[igate and make
flndings and recommendations in connection therewi[h; and

by itself and in Tts behalf, and after due consideratlon of all evidence and reports
offered at sald heartng, does flnd and de[ermine the following facts:
1. That t~c proposed use is properly one for which a condit~onal use
permit is autho•rized by Anaheim Muntcipal Code Section 18.61.050.502, to wi[: to
permit a contractor's storage yard with rialvers of:

2, That the proposed use is fiereby gran[ed subJect to the petTtioner's
stipulation that no equipment will be stored in the area designated for the required
on-site parking.

3. That the requested walvers are hereby denied on the basis that a
hardship was not dcmonstrated by the petttioner~ and that the petitioner stipulated
at the public hearing to provide the mintmum number of parking spaces and minimum
site screening of the outdoor storege area as required to meet the City of Anaheim
Code requirements.
4. That the proposed use wlll not adversely affect the adjoining land uses
and the growth and development of the area in which lt is proposed to be located.
5. That the size and shape of the site proposed for the use is adequate to
allow the full development of the proposed use tn a manner not detrimental to the
particular area nor to the peace, health, safety, and general welfare of the Citizens
of the City of Anafieim.
6. That the granting of the Condttional Use Permit under the conditions
imposed, if any, will not be detrimental to the pcace, health, safety and general
welfare ot the Citizens of the City of Anahelm.
7. That three (3) persons indicated thetr presence ac said pubiic hearing
in oppositlon; and that ~o correspond~nce was recefved in opposition to the subject
petition.
ENVIFONMEI~7AL IMPACT FINDING: That the Anaheim Ctty Planntng Commission has
revie~ed the proJec[ to permit a concractor's storage yard on a recCangularly-shaped
parcel of land consisting of approximately 1.1 acres, having a frontage of
approxtmately 160 feet on the west side af Miller Street, having a maximum depth of
approximately 294 feet and 6eing located approximately 1350 feet south of the
centeriine of Orangethorpe Avenue; and does hereby approve the Negative Declaratiun
from the requirement Lo prepare an envfronmen[al impact report on [he basis that
there vro uld be no stgnificant individual or cumulattve adverse environmental impact
due to the approval of thls Negative Declaratton stnce the Anaheim General Plan
designates the subJect property for general industrial land uses correnensurate wtth
[he proposal; tha[ no sensitive environmental impacts are fnvolved in the proposai;
[hat the ~nitial Study submltted by the petftioner indicates no significant
individuat or cumulatfve adverse envlronmental impacts; and thai ehe Negative
DeclaraLJon sub:tantlating Lhe `eregoing findings fs on file Tn Lhe City of Anaheim
Planning Department.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby granL, in par[, subject Petitton for Conditlonal Use Permit, upon the
following conditions which are hereby found to be a necessary prerequtsite to the
proposed use of the subJect property tn order to preserve the safeiy and general
welfare of the Citizerts of the City of Anahcim;
1, That st~eet lighting facilitfes along Miller Street shall be installed
prlor to flnal butlding and zoning tnspections unless otherwTse approved by the
Director of Public Utilities~ and in accordance with standard specifications on ftle
in the Office of the Director of Public Utilittes; and/or thai a bond~ ce~tificate of
deposit. Ietter of credii, or cash, In an amount and form satisfactory to the City or
Anahelm sha~l be posted wi[h the Ctty to 9uarantee the installation of the above-
mentioned requirements.
2. That trash storage areas shall be provTded in accordance witF~ approved
plans on file with the Office of the Director of Publlc Works.

3. That subject propcrty shall be developed substantlally in accordance
with plans and specifications on filc with the City of Anaheim marked Exhibit No. 1;
provided, however that the minimum number of parking spaces and the minimum site
screening of the outdoor storage area shall be provlded tn accordance with the City
of Anaheim Code requfrements.
4. That Conditfon Nos. 1, 2 and 3, above-mentloned~ shall be canpited with
prlor to final building and zoning inspectlons.
