WHEREAS, [he Anaheim City Planning Cort!mission did receive a verified
petition for Reclassification irom CHESTER H. PETERSON AND BE4E4LY ANN COMPTON, 221
N. Maplearood Street, Orange, California, 926F6, oomers, and BEAR BP.A~ID RANCH CONPANY,

property situated in the City of Anaheim, County of Oranae, State of California,
descr)bed as follows:

Parcel Maps, in the office of the Lounty Recorder of satd County,

WHEREAS, the City Planning Commission did schedule a public hearing at the
City Nall in the City of Anaheim on January 4, 1978, at 1:30 p.m., notice of said
public hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider
evidence for and against said pro~osed reclassificatton and to investigate and make
findings and recommendations in co~nection [herewith; said public hearinq having bee~
continued to the Planning Commisston meeting of January 16, 1~78; and
WtiEREAS, said Commission after due inspection, investigation an~t study made
by itself and in its behaif~ and after due consideration of all evidence and reports
offered at said hearing, does Tir+d and determine the foltowing facts:
1, That the petitloner proposes reclassification of subject property from
the RS-q-43~000(SC) (Residential/Agricul[urai, Scenic Corridor Overlay) Zone to the
RS-7200(SL) (Residential, Single-FaTily, Scenic Corridor Overlay) Zone.

2. That the Anaheim Generat Plan designates su6ject property for hillside
low-density residential land uses.
3. That the proposed reclassificatlon of subJect property is necessary
and/or desirable for the orderly and proper development of the community.
4. That the pr:,posed reclassification of subJect property does properiy
relate to the zones and thetr perrr,lt[ed uses locally established in close proximity
to subJect proper[y and to the zones and their permitted uses generally es[ablished
throughout the communfty,
5. That the proposed reclassificatian of suhJect property requires the
dedication and improvement of abutting streets in accordance with the Circulation
Element of the General Pian, due to Che anticipated increase in traffic wh(ch will be
generated by thc intensification of land use.

ENVIRO~lNE"JTAL ~HpACT FINDING: That the Anaheim City Plannina Canmission has
revlewed the subject proposal to reclassify ihe zoning from Rs-n-43~000(SC)
(P,ESIDENTIAL/AGRICULTURAL, SCF.~IIL COP,RIDOR OVE~LAY) to RS-720~(SC) (4ESIDENTIAL,
SIN,LE-FAMILY~ SCEtJIC LORRIDOR (1VERLAY) on an irregularly-shaped parcel of land
conSisCing of approximately 5•2 acres iocated south and west of the soutt~west corner
of Santa Ana Canyon Road and Av~nida Margarita, havinq approximate frontages of 231
feet on the south side of Santa Arsa Canyon Road and 52B feet on the northwest side of
Avenida Margarita, and does hereby approvc the Negative Declaration from the
requirement to prepare an environmental impact report on tfie basis that there would
be no siqn)ficant individual or cumulative adverse environmental impact due to the
approval of this Negative Declaration since [he Anaheim General Plan desionates the
subJect property for hillside loorde~sity residentiai land uses corrrnensurate with the
proposal; that no sensittve environmentai impacts are lnvolved in the proposal; that
the Inittal Study submit[ed by the petittoner (ndicates no significant individual er
cumulative adverse environmeniai impacts; and that the tle9ative Deciaration
substantiating the foregoing findings is on ffle in [he City of Anaheim Planning
Department.
NOW~ THEP,EFORE, BE IT RESOLI~ED that the Anaheim City Planning Cmxnlssion
does hereby grant subject Petition for Reclassification and, by so doing, that Title
18-Zoning of the Anaheim Muntcipal Code be amended ta exclude the above-described
property fran the RS-A-43,000(SC) (P,ESIDENTIAL/AGRICULTURAL, SCEPIIC CORRI~OR OUERLAY)
ZOtlE and to incorporate said described property inio the RS-7200(SC) (P,ESIDENTIAL,
MULTIPLE-FA"1ILY, SCENIC CORRIDQR OVERLAY) ZONE upon [he following conditlons which
are hereby found to be a necessary prerequtsite to the prooosed use of sub)ect
property in order to preserve the safety and general welfare of the Citizens of the
City of Anahetm:
1. That fire hydrants shall be installed and charged as required and
determined to be necessary by the Chief of the Fire Department prior to commencement
of str~ctural framing,
2. That subJect property shall be served by underground utilltles.

3. That drainage of subject nroperty shall be disnosed of in a manner
satisfactory to the City Engineer.
4. In the event that subject property is to be divided for the purpose of
sale, tease, or financing, a parcel map, to record the approved dtvislon of subject
property~ shall be submitted to and approved by the City of Anaheim and then be
recorded in the office of the Orange County Recorder.
5. That the owner of subJect property shall pay to the City of Anaheim the
aPPropriate park and recreation in-lieu fees as determined [o he appropriate by the
City Councll~ said fees to be paid at the tine the building permit is issued.
6. That an ordinance rezoning the subJect property shall in no event
become effective except upon or follo~•~ing the recordation op f~~a~ Tract Map No.
~~155 W~thin ttie time spectfied in Governmen[ Code Sectio~ 6~463.5 or such further
time as the advisory agency or City Louncil may grant.
7. Tha[ appropriate water assessment fees as determined by the Director of
Pub~i~ Utilities shall be patd to the City of Anaheim prtor to the issuance of a
butldin9 Permi[.
s. That all structures constructed on SubJect property shall be
constructed in accordance wiih che requirements of Fire Zone y,

Cond~tion Pios. 4 and F, ahove mentioned, shatl be conpleted, The provistons or
~i9hts 9~anted by this resolution shall become null and vofd by aciion of the
Planning Commission unless said conditions are compited with within one year from the
date hereof, or such further [imc as the Plannino Lommission may grant.

prior to final building and zoning lnspections.
