Halt in the tity of Anaheim on April 24, 1978, at 1:30 p.m., notice of said public
hearing having been duly g(ven as requlred by law and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 18.03~ to hear and consider
avidence for and agains[ sald proposed variance and to investigate and make findings
and recommendations fn connection therewith; and
WHEREAS, said Commisslon, afier due inspection, invesiigati~n and study made
by itself and In its behalf~ and after due consideration of all evidence a~d reports
offered at said hearing, does find and detcrmine the following fac[s:

2. That the above-mentioned waivcrs are hereby granted on the basis that
the petitioner demonstrated that a hardship exists in that the property Is
irregutarly-shaped having a width which ts substantially greater the than depth wlth
sole access being from an existing street, and proposed lots will be substantially
larger than lo[s in surroundtng area.
3. That there are exceptlonal or extraordinary circumstances or conditions
applicable ~o the property involved or to the intended usc of the proper[y [hat do
not app!y generaily to the property or class of use in the same vlcinity and zone in
[hat the property abuts the Carbon Creek Flood Lontrol Channel to the south, said
channel prohibiting any possible increase in [he proposed lot depths.
4, That the requested variance is necessary for the preservation and
enjoyment of a substantial property rIght possessed by otiier property in the same
vicinity and zone, and denied to the property in ques[ion in chat other nearby RS-
720~ zoned lots do not typically exceed 7200 square feet in area but the proposed
lots, although including waivers, wilt have substantially lar9er areas ranging from
9,351 to 15,759 square feet.
5, Tha[ the requested variance will not be materlally detrimen[al to the
public welfare or inJurlous Co the property or improvements 1~ such vicini[y and zone
in which the property is located.
6. That one person indlcated their presence ai said public hearing in
opposltion; and that no correspondence was received in oppositlon to the subject
petition.
ENVIRONMENTAL INPACT FIt~DING: Thai ttie Ar,aheim City Planning Canmission has
reviewed the subJect proposal to rec asslfy the zoning from RS-10,000 (Residential,
Single-Fam1ly) to RS-7200 (Residential, Single-Famlly) o~ an irregularly-shaped
parcel of land consisting of approxima[ely 1.2 acres located at the southerly
terminus of Lomita Screet hav(ng a frontage of approximately SSG feet on [he south
and east side of Lomita Street, having a maximum depth of approximately 293 feet, and
belna located approximately 240 feet south of the centerline of Claredge Drive, tc
establish a ti-lo[, RS-7200 subdivision Nlth waivers of minimum lot depth and minimum
lot wid[h; and does hereby approve the Negative Declaration from the requirement eo
prepare an enviranmental impact report on [he basis that :here vrould be no
significant indtvidual or cumula[ive adverse environmental impact due to the approval
of this Negative Deciaratlon since thr. Anahetm General Plan designates the subject
property for low denstty residentlal land uses commensurate Nith the proposal; that
no sensitive env(ronmental impacts are Involved in the proposal; th~t the Initial
Study submitted by the petltioner indlcates no significant indtvidual or cumulative
adverse env(ronmental impacts; and that the Negative Declaratton substantiating the
foregoing findings is on file in the City of Anaheim Pianning Department.
NON, TNEREFORE, BE IT RESOLVED that Che Anaheim Clty Pla~nin~ Commission
does hereby grant sub)ect Petltlon for Uariance, upon the following condittons which
are hereby found to be a necessary prerequisite tn the proposed use of the subJect
property in ord~r to preserve thc safety and general welfare of the Citizens of the
City of Anahcim:
