A RESOLUTIOk OF THE ANAHEIN CITY PLA~INItJG COMNISSION
THAT PETITION FOR CONDITIOMAL USE PERMIT N0. 1820 BE GRANTED
WHEREAS, the Anaheim City Plann(ng Canmission did receive a verified
Petition for Condttional Use Permtt from THE EUCIID ROMNEYA COMPANY, 505 Nor[h Tustin
Avenue, Suite 219, Santa Ana. Calftornia, 92705, owner, and 5. W. H. CORPORATION,
17231 Seventeenth Street, Tusttn, California 92630, agent, of certain real property
situated tn the City of Anahelm, County of Orange, State of California, described as:
Lots 1, 2, 3, 4 and 5 of Tract No. 3396, as shown on a Map
recorded in book 121, pages 8 and 9 of Miscellaneous Maps, in the
office of the County Recorder of safd Lounty. Except that portion
thereof incluJed within the folloHing descrTbed iand: Beginning at
the Southwest corner of the Northwest auarter of the Souihwest
quarter of Section 4, Tovrnship 4 South, Range 10 Wes[, as shoNn on
said map of Tract No~ 33°6; thence South 8~~ k2' S7" East 203.00
feet along the Southeriy line of said Northwes[ quar[er; thence
North Oo 02' 23" East 180.00 feet parallel with the 4lesterly iine

WHEREAS, the Ctty Planning Commission did hoic: a public hearing at the City
Hall in che City of Anaheim on April 24, 1978, ai 1:3h p.m., no[ice of said public
hearing having been duly given as required by law and in accordance rrith the
provisions of the Anaheim Municipal Code, Chapter 16,03, to hear and consider
evide~ce for and against said proposed condttiona! use and to investigate and make
flndings and recommenda[ions in connectton therPwith; and
41HEREAS, said Commtssion, after due inspection, investigation and s[udy made
by itsetf and in its behalf~ and after due consideration of a11 ev3dence and reporis
offered at said hearing~ does find and determinc the following facts:
1. That the proposed use is properly one for which a conditional use
permit is authorized by Anahetm Municipa) Code Sec[ion 18.44.05~.010 to wit: to
permit on-sale beer and wine in a proposed restaurant.
2, Tha[ thc proposed use will not adversely affect the adJoining land uses
and the growth and deve3opmeni of the area tn whlch it is proposed ta be located.
3. That che size and shape of the site proposed for the use is adequa[e to
allow the full development of the proposed use i~ a manner not detrimental to the
particular area nor to the Feace, health, safety, and general welfare of the Citizens
of the City of Anaheim.
4. That the granting of che Condttlonal Use Permit under the condtttons
imposed, if any, will not be detrlmental to the peace, health, safety and general
welfare of the Citizens of the Ctty of Anaheim,

5, That no one indicated thetr presence at said public hearing in
opposition; and that no correspondence was received in oppositlon to the subJect
petition.
EI~VIRONHEt17AL IMPACT FINDING: 7he Planning Directcr or his a~thorized
representat ve as eterm ne t at the proposed proJect falls within the deftnition
of Categorlcal Exemptions, Class 1, as deftned in Paragraph 2 of the City of Anahelm
Environmentai Impact Report Guidetlne~ and is, therefore, categaricatly exempt from
the requlrement to prepare an EIR.
NOW, THEREFORE. 8E IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petltlon for Conditional Use Permlt, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed use
of the subJect property in order to preserve the safety and general walfare of the
Citizens of the City of Anahelm:
1, Tha[ subject property shali be developed substantially in accordance
with plans and specifications on file wtth the Clty of Anaheim marked Exhiblt Nos. 1
through 5.
